Authorize the City Manager to negotiate and execute a first modification to Contract No. 9481 (CCS) in the amount of $470,338 (includes a 10% contingency) with PALP Inc., dba Excel Paving Company (Excel Paving), a California -based company, to resurface Beach Parking Lot 4S located at 2030 Ocean Avenue and improve striping and signage for the Beach Bike Path. This would result in a new contract amount not to exceed $6,040,174. 2. Authorize the Director of Public Works to issue any necessary change orders to complete additional work within budget authority. Executive Summary Beach Parking Lot 4S, located at 2030 Ocean Avenue, is in poor condition and is in need of maintenance. Conditions along the heavily used beach bike path vary from a shared -use path at the northern end to a separated bicycle and pedestrian path at the southern end. These varying conditions, coupled with the intensity of use in Santa Monica, contribute to confusion and safety challenges for users and beach goers. Construction plans for repaving the parking lot and improving the bike path striping and signage have been completed. Staff recommends that the City's current contractor for the Annual Paving Project, Excel Paving, complete the paving, striping and signage improvements in the amount of $470,338 for a new not to exceed contract amount of $6,040,174. Civil Source would provide inspection services under their current contract 9482 (CCS) for the Annual Paving Project. Background On September 27, 2011, the City Council approved construction Contract No. 9481 (CCS) with Excel Paving and a Professional Services Agreement, Contract No. 9482 (CCS) with Civil Source for construction management services associated with the Annual Paving Project to repave streets, repair damaged sidewalks and implement 1 recommendations of the Draft Bicycle Action Plan at various locations throughout the City. The project is currently under construction. Discussion The Civil Engineering Division completed a survey of City -owned surface parking lots in December 2011. Beach Parking Lot 4S was identified as a high priority project because of its deteriorated condition While the County -owned Marvin Braude Bikeway (beach bike path) extends from Pacific Palisades to Torrance, one of the most intensely used and challenging portions of the path is in Santa Monica. The conditions along the Santa Monica portion vary from a shared path at the northern end to a separated bicycle and pedestrian path at the south end, with a mixture of conditions north and south of the Santa Monica Pier. Additionally, in most sections of the path, beach goers must cross directly over the path often from beach parking lots. Combined, these conditions create confusion among path and beach users and produce unsafe conditions and mounting community complaints. Over the past two years, City staff has met with staff from the Los Angeles County to address these challenges in a comprehensive manner. While the County has shown support for addressing the conditions of the path, it does not have capital funding to design and /or implement improvements. Therefore, in order to expeditiously address the urgent safety concerns and conditions, Community and Cultural Services and Planning and Community Development staff have been working with Alta Planning + Design to develop a toolkit of markings, crossings, and signage to guide beach goers, bicyclist, and pedestrian users of the beach path through the changing conditions. The bike path improvement plans have been reviewed by the Recreation and Parks Commission and the Los Angeles County Public Works Department. The Coastal Commission issued a Waiver for the installation of the signage poles at its May 9, 2012, meeting. Completing this work before the anticipated summer crowds would require increasing the scope of the existing annual paving project. Due to the construction of Parking Structure 6, the City is deferring the repaving of 2nd Street from Colorado Avenue to 2 Wilshire Boulevard to a future contract thereby substituting this additional work to be completed by Excel Paving within the desired schedule. In addition, the City would be able to take advantage of volume pricing associated with the larger contract scope as well as saving on the mobilization cost which would be charged if bid as a separate item. Staff recommends a modification to Contract No. 9481 (CCS) in the amount of $470,338 with Excel Paving to resurface Beach Parking Lot 4S and improve striping and signage for the Beach Pedestrian and Bike Path. Staff anticipates that the net increase of Contract No. 9481 (CCS) would be approximately $310,338, once the final reduction in scope for the removal of the 2nd Street work is negotiated. Paving the parking lot and improving the beach pedestrian and bike path striping and signage before the peak demand summer period would provide enhanced facilities for residents and visitors alike. Financial Impacts & Budget Actions The contract modification to be awarded to Excel Paving is $470,338, for a new contract total of $6,040,174.
