Subject: Sole Source Approval for Purchase of Hillyard Chemicals
Recommended Action
Staff recommends that the City Council authorize the City Manager to award sole
source purchase orders to Hillyard, Inc., a California -based company, in an amount not
to exceed $480,000 for the purchase of cleaning chemicals and solutions, through June
30, 2016.
Executive Summary
This sole source purchase would provide cleaning chemicals and solutions to City
departments consistent with the City's sustainability goals. The recommended cleaning
chemicals were tested against three competitors in 2009. The purchase of Hillyard
cleaning solutions and chemicals, at a not to exceed amount of $480,000 through June
30, 2016, would continue the City's goal of using green seal certified cleaning products.
Background
In 2009, staff performed product testing on cleaning solutions, cleaning chemicals, and
dispenser units from three vendors over a period of three months. Both in -house and
contract custodial staff concluded that the cleaning products and dispenser units offered
by Hillyard, Inc., yielded the best results based on their superior performance of
cleaning solutions and dispenser units. Additionally, Hillyard offers a number of green
seal certified products consistent with the City's sustainability goals. All other Hillyard
products have been approved by the Office of Sustainability and the Environment for
citywide usage. Dispenser units were tamper proof and consistently dispensed the
solutions correctly and efficiently. Reliable dispenser units reduce product waste,
eliminate worker exposure to concentrated cleaning solutions, and increase the overall
efficiency of the various cleaning solutions. After the initial trial period, the cleaning
solutions and cleaning materials were ordered and stocked by the City Warehouse
beginning in 2010 through February 2012.

Discussion
All City facilities managed by Public Works are currently set up with the Hillyard
dispenser units. Both City and contract staff are trained on the proper usage of these
solutions and dispenser units. Due to the City's warehouse closure, staff is no longer
able to draw these supplies from the warehouse and requests authorization to purchase
cleaning products and dispenser units directly from Hillyard, Inc. A sole source is
required for this purchase because Hillyard, Inc. manufactures and patents their
cleaning solutions and dispenser units which are already implemented in several City
locations.
Financial Impacts & Budget Actions
The purchase orders to be awarded to Hillyard, Inc. would not exceed $480,000 through
June 30, 2016. Funds are included in the FY 2011 -13 budget within appropriate
Department accounts. Budget authority for subsequent fiscal years will be requested in
each budget cycle for Council approval. Future funding is contingent upon Council
approval.
