Subject: Deputy Inspection and Testing Services for Civic Center Parks
Recommended Action
Staff recommends that the City Council authorize the City Manager to negotiate and
execute a contract with Smith -Emery Company, a California -based company, in an
amount not to exceed $113,212 for deputy inspection and material testing services for
the Civic Center Parks (Palisades Garden Walk and Town Square Project).
Executive Summary
On June 28, 2011, Council approved a contract with W.E, O'Neil Construction Company
to provide design -build services for the Palisades Garden Walk and Town Square
project. In preparation of the construction work, a construction inspection firm is needed
to assist the City in providing deputy inspection and material testing services. These
services are required to ensure that structural concrete, masonry, and grout elements
are constructed to City standards and specifications. In January 2012, a Request for
Proposals was issued in order to solicit construction inspection proposals for the project.
After reviewing proposals received, staff recommends Smith -Emery Company to
provide deputy inspection and material testing services for the Palisades Garden Walk
and Town Square Project in an amount not to exceed $113,212. The project is
expected to be completed in summer 2013.
Background
On June 28, 2011, Council approved Design -Build Contract No. 9395 (CCS) with W. E.
O'Neil Construction Company (W. E. O'Neil) in the amount of $75,750, to provide
preconstruction services for the Palisades Garden Walk and Town Square Project.
On January 24, 2012, Council approved a Guaranteed Maximum Price Amendment to
Design -Build Contract No. 9395 (CCS) in an amount not to exceed $47,014,773

(includes an approximate 5% contractor contingency, 10% owner contingency and
allowances) with W. E. O'Neil Construction Company, for construction services of the
Palisades Garden Walk and Town Square. This resulted in a new contract in the
amount of $47,090,523.
Discussion
Consultant Selection
On July 22, 2011, the City issued a Request for Qualifications (RFQ) for deputy
inspection and material testing services for various City projects. These services are
required to ensure that structural concrete, masonry, and grout elements are
constructed to City standards and specifications. The RFQ was published in the Santa
Monica Daily Press and posted on the City's online bidding website. A total of 21 firms
responded to the RFQ. A selection committee comprised of Public Works staff
reviewed the qualifications and developed a prequalification list of qualified deputy
inspection and material testing firms.
In January 2012, four firms including Smith -Emery Company, Willdan Geotechnical,
Koury Engineering & Testing, and Heider Engineering Services, from the prequalified
list were asked to provide proposals for deputy inspection and material testing services
for the Palisades Garden Walk and Town Square Project. Upon reviewing the proposals
and meeting with the firms, staff recommends Smith -Emery Company based on their
proposal, competitive prices, experience, references, and qualifications of the proposed
project inspection team. The proposed project inspection team includes one deputy
inspector ($78.50 /hr), 275 concrete cylinder tests ($20.00 /ea), 75 masonry mortar and
grout tests (50.00 /ea). The inspector will be on the project 140 days from April 2012 to
July 2013.
Smith -Emery Company has completed inspection and testing services for various public
sector projects in Southern California. These projects include community colleges,
sanitation districts, municipal office facilities, K -12 schools and higher education
facilities. Some of Smith -Emery Company's clients included the City of Long Beach,

City of Los Angeles, City of Buena Park, City of Fullerton, Los Angeles County Museum
of Arts, Los Angeles Unified School District, Los Angeles Sanitation District, and City of
Santa Monica.
The project is expected to be completed in summer 2013
Financial Impacts & Budget Actions
This contract, to be awarded to Smith -Emery Company for deputy inspection and
material testing services for the Palisades Garden Walk and Town Square Project in the
amount of $113,212, is part of the January 24 2012, Council- approved Guaranteed
Maximum Price Amendment to Design -Build Contract No. 9395 (CCS) with W.E. O'Neil
Construction Company. That contract included a total allowance of $5,126,248 for third -
party contracts, of which the Smith -Emery Company contract is one. Funds in the
amount of $113,212 for the third -party contract with Smith -Emery Company for deputy
inspection services have already been encumbered in the FY 2011 -13 budget in
account R01207117.589600, under Design -Build Contract No. 9395 (CCS). The Smith -
Emery Company contract will be a separate item under existing Contract No. 9395
(CCS).
