r-10663EIR Certification Resolution City Council Meeting: March 20, 2012 Santa Monica, California RESOLUTION NO. 10563 (ccS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT ON THE 710 WILSHIRE BOULEVARD MIXED -USE PROJECT WHEREAS, a Notice of Preparation of an Environmental Impact Report for the 710 Wilshire Boulevard Mixed Use Project was issued on June 9, 2010; and WHEREAS, a Notice of Completion of a Draft Environmental Impact Report was published on July 18, 2011 in compliance with the California Environmental Quality Act and the City of Santa Monica CEQA Guidelines; and WHEREAS, the Draft Environmental Impact Report was circulated for a 45 -day period which ended on September 1, 2011; and WHEREAS, the Draft EIR analyzed two potential development scenarios: Development Scenario 1, which includes the mixed use building at 1218 Lincoln Boulevard, and Development Scenario 2, which is identical to Development Scenario 1, except that it would not include the development of the mixed use building; and 1 eff44 WHEREAS, following circulation of the Draft EIR, the project applicant elected not to pursue Development Scenario 1 of the proposed project; and WHEREAS, the Final EIR was published in December, 2011; and WHEREAS, on January 25, 2012, the Planning Commission reviewed and considered the Final EIR and recommended that the City Council certify it; and WHEREAS, the City Council has reviewed and considered the contents of the Final EIR in its decision - making process; and WHEREAS, on March 20, 2012 the City Council, as Lead City Agency, reviewed the Final EIR; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council has reviewed and considered the information contained in the Final Environmental Impact Report on the 710 Wilshire Boulevard Mixed- Use Project ( "Final EIR ") prior to acting on the project. SECTION 2. The City Council certifies that the Final EIR for the project was 2 eff44 presented to the City Council, that the Final EIR for the project was completed in full compliance with State law and City CEQA Guidelines, that there was adequate public review of the Draft Environmental Impact Report, that it has considered all comments on the Draft Environmental Impact Report and responses to comments, that the Final Environmental Impact Report adequately discusses all significant environmental issues, that the Final Environmental Impact Report reflects the independent judgement and analysis of the City, and that the City Council has reviewed and considered the information contained in the Final Environmental Impact Report in its decision - making process prior to acting on the project. SECTION 3. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
