A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA WAVING PAST BUSINESS LICENSE TAXES AND
PENALTIES FOR FARMER'S MARKET PARTICIPANTS
WHEREAS, the Santa Monica Municipal Code requires virtually all for - profit
businesses that operate within the City to obtain a City Business License and pay
Business License Taxes; and
WHEREAS, the City operates and administers several successful Farmer's
Markets that provide excellent and valued services to residents and restaurants; and
WHEREAS, in the past, Farmer's Market participants have been mistakenly
informed that the City's Business License Tax requirements did not apply to them; and
WHEREAS, based on this information, participants have, for years, operated at
the City's Farmer's Markets without obtaining a City Business License and without
paying City Business License Taxes; and
WHEREAS, the mistaken information provided to Farmer's Market participants in
the past has been corrected and participants will be required to obtain Business
Licenses and pay Business License Taxes in the future; and
WHEREAS, the City strives to apply its laws fairly and equitably.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The City hereby waives all Business License Taxes, associated
penalties and processing fees for all City of Santa Monica Farmer's Market participants
for all past fiscal years, up to and including the 2011 -2012 fiscal year.
SECTION 2. The City Clerk shall certify to the adoption of this Resolution, and
thenceforth and thereafter the same shall be in full force and effect.
