Authorize City Manager to accept the dedication of additional public right -of -way on Virginia Avenue at Edison Language Academy from the Santa Monica - Malibu Unified School District (SM -MUSD) to permit realignment of the sidewalk in order to accommodate a drop -off area. 2. Authorize SM -MUSD to proceed with the construction of sidewalk improvements per easement agreement. Executive Summary As part of rebuilding Edison Language Academy, the Santa Monica - Malibu Unified School District (SM -MUSD) is proposing a passenger drop -off zone on Virginia Avenue adjacent to the new front entrance to the school. To accommodate the drop off zone, SM -MUSD proposes to dedicate land to the City for additional public right -of -way resulting in the need to realign the public sidewalk adjacent to school property. Realigning the sidewalk to accommodate the drop -off zone will require the removal of nine street trees. These trees will be replaced with 13 trees within the new sidewalk area. One of the existing trees needs to be relocated immediately to provide access to the construction site and is being posted in accordance with the Urban Forest Master Plan posting requirements. Background The City regularly engages with the Santa Monica - Malibu Unified School District (SM- MUSD) in a partnering effort to promote strategic and efficient development in Santa Monica. Both agencies share a mutual goal of enhancing the learning environments and public infrastructure within the community. Over the last 12 months, the City has worked very closely with representatives of the SM -MUSD to review multiple SM -MUSD sponsored capital projects in a cooperative effort to ensure the timely completion of 1 important school facilities while, at the same time, ensuring relevant City requirements are met. The Edison Language Academy is one of several school district projects the City is currently reviewing for compliance with relevant City requirements. Discussion The new construction at Edison Language Academy will include replacing all existing facilities with an entirely new campus including relocation of the front entrance to Virginia Avenue. These changes will include 27 classrooms for kindergarten through fifth grade, two pre - school classrooms, a new library and cafeteria. New administrative and support facilities will be constructed, which will offer a welcoming and inviting environment for both students and visitors. Outdoor improvements will include new community accessible playfields and playgrounds, outdoor eating and learning areas, and new landscaping throughout the campus. The Edison Language Academy project showcases improved day lighting, improved air quality and natural ventilation, reduced water use and storm water treatment, and an overall improved environment for Santa Monica's student community. The street improvement plans for the Edison Language Academy were first submitted for review in December 2009. After incorporating City review comments, the final plans were submitted for approval in January of this year. These plans reflect the need for a drop -off zone along Virginia Avenue to provide safe pickup and drop -off for the students while minimizing impact to traffic circulation. SM -MUSD is providing additional public right -of -way along a portion of their frontage on Virginia Avenue to accommodate this drop -off zone between a travel lane and a realigned public sidewalk adjacent to school property. On February 16, 2012 the School Board voted to grant additional public right - of -way on Virginia Avenue at Edison Language Academy to the City of Santa Monica to permit realignment of the sidewalk in order to accommodate a drop -off area. The drop - off zone will require the removal of nine existing street trees and planting of replacement trees. The changes due to the installation of the drop -off zone will result in an increased number of street trees from nine to 13, a more uniform tree distribution and an overall enhanced pedestrian experience. Although the proposed removal of the existing street ra trees predates the adoption of the Urban Forest Master Plan, eight of the nine current trees are not viable candidates for relocation based upon structure and health. The proposed replacement trees, Canary Island Pine (Pinus canariensis), are approved in the tree species replacement list in the Urban Forest Master Plan. One of the street trees (Geijera parviflora) identified for relocation needs to be moved immediately for purposes of access to the construction site. This tree will be boxed and maintained for replanting along the Virginia Avenue sidewalk as part of the site improvements. Financial Impacts & Budget Actions There is no financial impact to this Council action. All costs associated with the construction of public improvements and relocation of trees will be borne by the Santa Monica - Malibu Unified School District. SAM RE: ADOPT RESOLUTION NO. 11 -08 — RESOLUTION OF INTENTION TO DEDICATE AN EASEMENT FOR PUBLIC STREET PURPOSES TO THE CITY OF SANTA MONICA — EDISON LANGUAGE ACADEMY PROJECT — MEASURE BB RECOMMENDATION NO. A.25 It is recommended that the Board of Education ( "Board ") adopt Resolution No. 11 -08 to declare its intention to dedicate a portion of the Edison Language Academy to the City of Santa Monica for a sidewalk fronting the new drop -off and pick -up lane along Virginia Avenue for the Edison Language Academy Project. DISCUSSION: The Santa Monica - Malibu Unified School District currently owns and operates the Edison Language Academy ( "ELA ") located at 2425 Kansas Avenue and 2508 and 2512 Virginia Avenue, Santa Monica, California 90815 -1732. The Edison Language Academy's property includes certain sidewalks along a portion of Virginia Avenue. As part of the Edison Language Academy Project, a new drop -off and pick -up lane, accompanying sidewalk, and a crosswalk ramp are to be constructed. The District would like to dedicate the "Easement" for the sidewalk serving the drop -off and pick -up lane and the crosswalk ramp to the City of Santa Monica, as described in Exhibit "A" of the attached Resolution. The District desires continual sidewalk and roadway access to Edison Language Academy for its students, parents, teachers, staff, and invitees with the least exposure to liability. The District does not need the Easement area for classroom buildings or educational purposes. The District would enjoy the continued use of the sidewalks and the drop -off and pick -up lane and limit its liability that arises out of, or is connected with, the operation, maintenance, repair, reconstruction, and /or use of the sidewalk serving the drop -off and pick -up lane. Education Code Section 17556 allows for the dedication of the Easement by the District. Education Code Section 17557 provides that the District may dedicate the Easement only if the Board first adopts a resolution declaring its intention to dedicate the Easement in a regular open meeting by a two - thirds vote of all its members. After adopting a resolution of intention to dedicate the Easement, Education Code Section 17558 requires the District to give 10 -days' notice of a public hearing and consideration of adopting a resolution to dedicate the Easement. After considering the staff's presentation, public comments, and any formal protests, at the public hearing, the District will consider adopting a Resolution to Dedicate an Easement for Public Street Purposes to the City of Santa Monica. If the vote passes by two - thirds, the District can dedicate the Easement to the City of Santa Monica with no further proceedings. The real property upon which the Easement is to be located is not needed for school classroom buildings or educational purposes. 2.
