Recommended Action Staff recommends that the City Council: 1. Hold a public hearing to receive comments regarding the vacation of the public right -of -way on Olympic Place South and a portion of 1" Court Alley and the dedication of a new public right -of -way to extend 1St Court Alley through the Redevelopment Agency -owned parcel at 1665 Ocean Avenue. 2. Approve the request to vacate Olympic Place South and a portion of 1St Court Alley and dedicate a new right of way extension of 1St Court Alley. 3. Adopt the attached resolution ordering the vacation and dedication. Executive Summary With the development of the Palisades Garden Walk and Town Square project, the need for a public right -of -way within the park site is no longer required in the area north and east of Chez Jay Restaurant. A public right -of -way vacation combined with the relocation of vehicular access to the City -owned property between Chez Jay Restaurant and the Ocean Lodge Motel site is an essential component of the project. Background On October 25 2011, Council reviewed and approved the Palisades Garden Walk and Town Square design plans for the new park. The plans included proposals to vacate and dedicate certain areas of public right -of -way within the planned park area. Prior to this Council meeting, the project plans were presented to the following boards and commissions as a courtesy visit or for approval: Architectural Review Board; Coastal E Commission; Commission on the Senior Community; Disabilities Commission; Landmarks Commission; Planning Commission; Recreation and Parks Commission; and Urban Forest Master Plan Task Force. On January 10 2012, Council directed the City Clerk to set a public hearing on the proposed vacation and dedication proceedings for February 14, 2012, at 5:30 PM, in the City Hall Council Chambers. Notice of the date, hour and place of the public hearing was published from January 30 to February 14, 2012, in the Santa Monica Daily Press. Notice of the time and place of the public hearing was posted along the area of the proposed vacation. Publication and posting of notices were done in accordance with Part 3 Chapter 3 of the California Streets and Highways Code "General Vacation Procedures." Discussion Olympic Place South is an alley that runs east /west along the northern edge of Chez Jay. The portion of 1st Court Alley that is proposed in this report runs north /south at the eastern edge of Chez Jay Restaurant. These two areas are to be incorporated into the park and would allow for future expansion into the park for any development of the Civic Center Specific Plan, including a park restaurant. The project proposes to dedicate a new 25 -foot wide public right -of -way that would connect with the existing segment of 1st Court Alley behind the Ocean Lodge Motel and would run through the center of the vacant parcel between the two businesses. Parking would be maintained on either side of the new public right -of -way. Access to the new route would be from the new Olympic Drive South and from Ocean Avenue. Existing utilities and easements would be maintained. 6 Financial Impacts & Budget Actions There is no financial impact to this Council action. All costs associated with the construction of public improvements and relocation of City -owned and private utilities are included in the design -build contract as part of the overall Palisades Garden Walk and Town Square project budget.
