Subject: Beach Restroom Facilities Replacement Contract Modification
Recommended Action
Staff recommends that the City Council:
1. Authorize the City Manager to negotiate and execute a second modification to
Contract 2236 (CCS) in the amount of $21,952 with Monarch Plumbing &
Mechanical, a California -based company, for additional scope of work as a result
of unforeseen site conditions for the Beach Restroom Facilities Replacement
Project. This will result in a new contract in the amount of $220,486.
2. Authorize the Director of Public Works to issue any necessary change orders to
complete additional work within budget authority.
Executive Summary
In fall 2010, the general contractor for the Beach Restroom Facilities Replacement
Project, CWS Systems Inc., began construction to replace or upgrade a total of seven
restroom facilities on Santa Monica State Beach built nearly 30 years ago. During
replacement and testing of the sewer lateral by Monarch Plumbing & Mechanical at the
2600 Ocean Front Walk location, unforeseen site conditions necessitated additional
scope of work and an extension of the construction schedule. The existing contract
contingency is not sufficient to cover the additional costs of the added scope of work.
Staff is requesting a second modification to Contract 2236 (CCS) with Monarch
Plumbing & Mechanical in the amount of $21,952, for a total contract amount of
$220,486, in order to cover these additional costs.
Discussion
To expedite replacement of the sewer lateral at the 2600 Ocean Front Walk site,
Monarch Plumbing & Mechanical was awarded Contract 2236 (CCS) following a
competitive bid process in an amount not to exceed $61,034.

On July 26, 2011, to address unforeseen conditions including a failed sewer main,
Council approved a first modification to Contract 2236 (CCS) in the amount of
$137,500, for a total contract amount of $198,534.
Further testing of the replaced sewer lateral revealed that densely packed soil resulted
in deflection of the lateral preventing it from flowing suitably. Extensive removal and
replacement of concrete curb, sidewalk, asphalt paving, and the immediate emergency
replacement of 20 feet of sewer lateral were necessary to ensure the integrity of the
new sewer lateral and eliminate a possible threat to public health, welfare and safety
due to sewage backup. Staff recommends a second modification to Contract 2236
(CCS) with Monarch Plumbing & Mechanical in the amount of $21,952 to cover the
additional costs for removal and replacement of curb, sidewalk, paving and a portion of
sewer lateral serving the restroom site. This will close out all outstanding issues
associated with the project.
Financial and Budget Actions
The second modification to Contract 2236 (CCS) to be awarded to Monarch Plumbing &
Mechanical is $21,952, for a new contract amount of $220,486. Funds are available in
the FY2011 -12 budget in account 0010747.589000.
