M-100411CITY OF SANTA MONICA CITY COUNCIL MINUTES OCTOBER 4, 2011 A special meeting of the Santa Monica City Council was called to order by Mayor Bloom at 5:33 p.m., on Tuesday, October 4, 2011, at City Council Chambers, 1685 Main Street. Roll Call: Present: Mayor Richard Bloom Mayor Pro Tem Gleam Davis Councilmember Robert T. Holbrook Councilmember Kevin McKeown Councilmember Shriver Absent: Councilmember Pam O'Connor Councilmember Terry O'Day Also Present: City Manager Rod Gould City Attorney Marsha Jones Moutrie City Clerk Maria M. Stewart CONVENE /PLEDGE On order of Mayor, the City Council convened at 5:33 p.m., with Councilmembers O'Connor and O'Day absent. Assistant City Manager Elaine Polachek led the assemblage in the Pledge of Allegiance. CLOSED SESSIONS There being no one present for public comment, the City Council recessed at 5:34 p.m., to consider closed sessions and returned at 6:34 p.m., with Councilmembers O'Connor and O'Day absent, to report the following: 1 -A: Conference with Legal Counsel —Anticipated Litigation: Anticipate significant exposure to litigation pursuant to Government Code Section 54956.9 (b): - 1 case City Attorney Marsha Moutrie reported that this item was heard with no reportable action taken. 1 -B: Conference with Legal Counsel - Anticipated Litigation: Initiation of Litigation pursuant to Section 54956.9c. (California Regional Water Quality Control Board, Clean Up and Abatement Order No. R4- 2008 -0034, Former Gillette Paper Mate facility, 1681 26th Street, Santa Monica, Ca.) October 4, 2011 City Attorney Marsha Moutrie reported that this item was heard with no reportable action taken. 1 -C: Conference with Legal Counsel — Existing Litigation: LLty of Santa Monica v. Hershey Associates, LASC Case No. SC 110734. Motion by Councilmember McKeown, seconded by Mayor Pro Tern Davis, to approve Settlement No. 9485 (CCS), related to a tenant dispute, in the amount of $48,000. The motion was approved by the following vote: AYES: Councilmembers Holbrook, McKeown Mayor Pro Tern Davis, Mayor Bloom NOES: None ABSENT: Councilmembers O'Connor, O'Day ABSTAIN: Councilmember Shriver STUDY SESSION: 4 -A: Proposed Phase II Public Process regarding the Santa Monica AIRPORT CAMPUS - Airport Campus — recommendation that Council review and comment on PUBLIC PROCESS the Santa Monica Airport Campus Phase I Public Process findings and PHASE II direct staff to proceed with the proposed Phase II Public Process concept, was presented. Los Angeles City Councilmember Bill Rosendahl commented on the need for the City of Los Angeles and the City of Santa Monica to cooperate to l address the problems affecting all residents. Members of the public Gwen Rinehart, William Follett, Martin Rubin, Jerry Rubin, William Sadler, Lies Kraal, Valerie Griffin, Sergey Ryazantsen, Laura Silagi, Denise Barton, Val Davis, Thomas Paccoretti, Michael Brodoky, Lisa Hughes, Susan Harrison, Charles Rollins, Zina Josephs, Ellen Harman, Anne Eggelton, Michele Perrone, Kathy Knight, Thane Roberts, Richard Brown, Mike Salazar, Olson St. George, Cathy Larson, John Wayward, Rob Nukes, D.J. Sherman, David Goddard, and Tony Nitti commented on various aspects of the presentation and spoke generally in opposition to the current operation of the airport. Members of the public Mike Myers, Sophia Zhorne, Primo de Jesus, Rick Russell, Michael Kent, Howard Israel, Joseph Justice, Ali Safai, Cary Charlin, and Elvan Price, Jr., spoke generally in support of airport - related enterprises including but not limited to flight schools, airport access, and public art. Discussion ensued related to points made during the presentation and comments from members of the public. 2 October 4, 2011 PUBLIC INPUT: Motion by Mayor Pro Tem Davis, seconded by Mayor Bloom, to move to the Phase II of the public process concept including the direction to staff to reach out to regional neighbors to involve them in the process, to continue reviewing information and studies received from related health and air quality organizations and update Council, and to explore declaratory relief action.
