r-10622City Council Meeting 10-11-2011 Santa Monica, California RESOLUTION NUMBER 10622 (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA DEDICATING A PORTION OF CITY -OWNED PROPERTY FOR USE AS A PUBLIC RIGHT-OF-WAY WHEREAS, the City of Santa Monica (the "City") is the owner of the property described in Exhibit A, which it desires to have developed as a portion of Olympic Dive and dedicated for use as a public right-of-way; and WHEREAS, the establishment. of Olympic Drive from Fourth Street to Ocean Avenue is included in the adopted the Civic Center Specific Plan (CCSP), which was approved in 1993 and updated in 2005 in setting forth the plan for the Village Special Use District as a mixed-use, urban neighborhood; and WHEREAS, Olympic Drive from Fourth Street to Main Street has been completed and dedicated as a public right-of-way by public user; and WHEREAS, on May 13, 2008, the City amended the CCSP to incorporate the design of the Civic Center Village mixed-use development and approved a Development Agreement (DA) with Related/Santa Monica LLC (the "Developer") that requires the Developer to construct the Olympic Drive Extension from Main Street to Ocean Avenue; and WHEREAS, the fee simple ownership of the property was transferred to the City by the Redevelopment Agency of the City of Santa Monica's (the "Agency") on March M 2011, pursuant to Cooperation Agreement No. 9267 (CCS/RAS) and Implementing Agreement No. 9318 (CCS/RAS); NOW, THEREFORE, THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: Section 1. The portion of City -owned property described in Exhibit A and shown on Exhibit B is dedicated to the public for use as a public -right-of-way. Section 2. The City Clerk shall certify to the adoption of this Resolution and thenceforth and thereafter the same shall be in full force and effect.
