A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA APPROVING THE APPLICATION FOR GRANT
FUNDS FOR THE ENVIRONMENTAL ENHANCEMENT AND MITIGATION PROGRAM
UNDER THE SECTION 164.56 OF THE STREETS AND HIGHWAYS CODE FOR THE
URBAN FOREST ENHANCEMENT ALONG EXPO LIGHT RAIL AND THE
EXECUTION OF DOCUMENTS NECESSARY TO PARTICIPATE IN THE PROGRAM
WHEREAS, the City of Santa Monica, a municipal corporation, wishes to apply
for and receive an allocation of no more than $350,000 in grant funds through the
California Natural Resources Agency Environmental Enhancement and Mitigation
Program; and
WHEREAS, the Legislature of the State of California has enacted AB 471
(Chapter 106 of the Statutes of 1989), which is intended to provide $10 million annually
for a period of 10 years for grant funds to local, state and federal agencies and nonprofit
entities for projects to enhance and mitigate the environmental impacts of modified or
new public transportation facilities; and
WHEREAS, the Natural Resources Agency has established the procedures and
criteria for reviewing grant proposals and is required to submit to the California
Transportation Commission a list of recommended projects from which the grant
recipients will be selected; and

WHEREAS, said procedures and criteria established by the Natural Resources
Agency require a resolution certifying the approval of application by the Applicant's
governing body before submission of said application to the State; and
WHEREAS, the application contains assurances that the Applicant must comply
with; and
WHEREAS, Urban forest enhancement along the Expo light rail furthers the Land
Use and Circulation Element policies and goals for a sustainable community and the
Urban Forest Master Plan; and
WHEREAS, the Applicant, if selected, will enter into an agreement with the State
of California to carry out the environmental enhancement and mitigation project.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The City of Santa Monica shall submit to the California Natural
Resources Agency an application to participate in the Environmental Enhancement and
Mitigation Program in response to the invitation for applications for FY 11 -12, requesting
a funding allocation in an amount up to $350,000 to design and construct the urban
forest enhancement along the Expo light rail in Santa Monica.
SECTION 2. If the application for funding is approved, the City of Santa Monica
hereby agrees to use the Environmental Enhancement and Mitigation Program funds for
eligible activities in the manner presented in the application as approved by the
California Natural Resources Agency and in accordance with program Guidelines.

SECTION 3. The City Manager, or Manager's designee is authorized to conduct
all negotiations and to execute in the name of the City of Santa Monica the application,
the Standard Agreement, and any and all other documents required by the California
Natural Resources Agency for participation in the Grant Program, including any
amendments thereto.
SECTION 4. The City Clerk shall certify to the adoption of this Resolution, and
thenceforth and thereafter the same shall be in full force and effect.
