A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
AUTHORIZING THE CITY MANAGER TO SUBMIT AND EXECUTE USED OIL
PAYMENT PROGRAM APPLICATIONS AND RELATED AUTHORIZATIONS TO THE
DEPARTMENT OF RESOURCES RECYCLING AND RECOVERY {CalRecycle)
WHEREAS, pursuant to Public Resources Code § 48690 the Department of
Resources Recycling and Recovery (CalRecycle), formerly known as the California
Integrated Waste Management Board (CIWMB}, has established the Used Oil Payment
Program {OPP} to make payments to qualifying jurisdictions for implementation of their
used oil programs; and
WHEREAS, pursuant to Public Resources Code § 48690 the Department of
Resaurces Recycling and Recovery (CalRecycle), formerly known as the California
Integrated Waste Management Board {CIWMB), has established the Used Oil Payment
Program (OPP} to make payments to qualifying jurisdictions for implementation of their
used oil programs; and
WHEREAS, in furtherance of this authority CalRecycle is required to establish
procedures governing the administration. of the Used Oil Payment Program; and
WHEREAS, CalRecycle's procedures for administering the Used Oil Payment
Program requires, among other things, an Applicant's governing body to declare by
resolution certain authorizations related to the administration of CalRecycle's Used Oil
Payment Program.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The submittal of applications to the Department of Resources
Recovery and Recycling for the Used Oil Payment Program on behalf of itself as Lead
Agency for a period of five years from July 28, 2011 through July 28, 2015 is hereby
authorized.
SECTION 2. The City Manager, or designee is hereby authorized to execute in
the name of the City of Santa Monica all necessary applications, agreements, contracts,
annual reports, expenditure reports, and amendments, thereto for the purposes of
securing payments and to implement and carry out the purposes of the Used Oil
Collection Program.
SECTION 3. The City Clerk shall certify to the adoption of this Resolution, and
thenceforth and thereafter the same shall be in full force and effect.
