This report transmits proposed regulations for use of the Santa Monica Mall.
Background
At its regular meeting March 26, 1974 the Council adopted a motion to refer
to the City Manager for study and report the request of representatives of the
Santa Monica Community Service Council for permission to erect and use a
permanent kiosk or portable stand(s) on the Mall to dispense information to
various persons regarding the availability of numerous community services.
The staff has met with representatives of the Community Services Council
and a proposal on this matter will be forthcoming for Council consideration
during the next 45 days. However, during the course of this study it was
discovered that there is no adopted set of regulations for the use of the Mall.
Therefore, it is the objective of this .recommendation to regulate the use of
the iulall through a centralized permit procedure. To date,. permission for
uss of the IvIall has been handled by the City Manager's Office. It is felt that
this is not a proper functional responsibility for this office in that it has taken
too much time away from its overall management responsibilities.

Recommendation
It is recommended that the Cauncil adopt a motion allowing the use of the
areas immediately adjacent to and on the north side of the bandstands in
each block of the Mall for various groups and individuals incorporating in
the motion the -regulations on the attached sheet marked Exhibit A,

PROPOSED REGULATIONS FOR USE OF 1T HE MALL
1. Compliance with Sections 3611 through 3614 of the Santa Monica Ntunicipal
Code (Vehicles on the Mall) and applicable zoning regulations of the City
of Santa Monica.
2. No permanent installation of any type to be permitted. All tables, chairs
or other furniture to be removed by 9:00 p. m. (not permitted to remain
overnight).
~3. Area of occupation is restricted to an area equal to the width of the band-
stand and projecting into the Mall not more than six (6) feet from the norfli
side of the bandstand.
4. Ali groups or individuals using this area shall keep it clean.
5. Such tables or other furniture shall be manned at all times (no unmanned
tables for the distribution of literature).
6. Tables, chairs or other furniture shall not be placed on the Mall prior to
9:00 a. m. to allow for Mall cleaning by the Public Works Department.
7. The right to use this area shall be revocable by the City at any time, through
the Director of Public Works, in order to mitigate conflicts with special
civic or promotional events scheduled for the Mall or for any other reason
that appears. valid in the judgment of the Director of Public Works.
8, i\7o signs used in publicity shall be placed on or attached to any platform,
bandstand, planter or other piece of Mall furniture.
9. The playing of musical instruments shall be prohibited.'

I1. The use of such designated areas shall be on a first-come, first-serve basis
and shall be limited to no more than one (1) week in each thirty (30) day
period subject to availability.
I2. Application may be made to and all permits issued by the Department of
Public Works, 1685 Main Street (City Hall), Santa Monica, CA 90401.
13. Applicant shall keep a copy of the permit available for inspection by any
officer or employee of the City of Santa Monica during the applicant's
presence on the Mall.
14. The use of sound amplification equipment is prohibited.
15. Compliance with Section 6241(D) of the Municipal Code regarding prohibition
of solicitation of trade on the sidewalk or street.
