Various community service groups have expressed a desire to have a designated
space or spaces on the Mall to inform the public of their particular service,
During the course of the study on this matter it was discovered that there is no
adopted set of regulations for the use of the Mall.
Background
At its regular meeting March 26, 1974 the Council adopted a motion to refer to
the City Yianager for study and report the request of representatives of the Santa
Monica Community Service Council for permission to erect and use a permanent
kiosk or portable stand(s) on the Mall to dispense information to various persons
regarding the availability of numerous community services.
Three objectives are sought to be attained by the recommendation:
to Preserve the aesthetic and functional integrity of the Mall,
2, Provide a space on public property for use by various community service
organizations to get their particular message across to their potential
clientele,
3. Regulate the use of the Mall through a centralized permit procedure.

Alternative Solutions -
1. Reject the idea of allocating such space for this use on the Mall.
Pro: The argument can be made that the Mall should be limited to providing
public access tb adjacent commercial areas,
Con: The argument can also be made that because the Mall attracts so many
people, it is an ideal medium for the work of community service organi-
zations.
2„ Provide such. a space at some other location. This alternative does not appear
to be acceptable since it is likely that space on private property would be costly
and no public area provides -the same level of exposure as does the Mall,
3. Provide additional areas on the Mall. This approach is not recommended until
the level of demand and usage is determined. Flxrther, any additional areas so
designated may conflict with the essentially commercial nature of the Ma11,
4. Provide for alternate locations on the Ma11. The areas immediately adjacent
to and on the north side of each bandstand are recommended as having the least
impact on the conirmercial function of the Mall. "
5. Construct a permanent facility (booth or kiosk) to serve this function. A per-
manent booth or kiosk probably could not be built adjacent to the bandstands
(which is the proposed to cation. of temporary facilities) since it would interfere
with the function and purpose of the bandstands. It is doubtful that one such
permanent facility would be sufficient to serve the many community service
groups, FLirther, any such booths or kiosks should be similar in design and
in use of materials to other Mall features, Such a permanent facility could
cost between S7, ODO to $10, 000 per Mall block.
Recommendation
It is recommended that the Council adopt a motion allowing the use of the areas
immediately adjacent to and on the north side of the bandstands in each block of the
Mail for community service groups incorporating in the motion the regulations on
the attached sheet marked E~;hibit A.

PROPOSED REGULATIONS FOR USE OF THE MALL
1, Compliance with Sections 3b11 through 3614 of the Santa Monica Municipal
Code (Vehicles on the Mall) and applicable zoning regulations of the City
of Santa Monica,
2, No permanent installation of any type to be permitted. All tables, chairs
or other furniture to be removed by 9:00 p. m. (not permitted to remain
overnight),
3, Area of occupation is restricted to an area equal to the width of the band-
stand and projecting into the Ntall not more than six (6) feet from the north P
side of the bandstand,
4. All groups using this area shall keep it clean.
5. Such tables or other furniture shall be manned at all times (no unmanned
tables for the distribution of literature).
6. Tables, chairs or other furniture shall -not be placed on the Mall prior to
9:00 a. m, to allow for Mall cleaning by the Public Works Department.
7. The right to use this area shall be revocable by the City at any time, through
the Director of Public Works, in order to mitigate conflicts with special
events scheduled for the Mall or for any other reason that appears valid in
the judgment of the Director of Public Worlcs.
8. No signs used in publicity shall be placed on or attached to any platform,
bandstand, planter or other piece of Mall furniture,
9. The playing of musical instruments shall be prohibited,
10, Commercial filming shall be prohibited.
11. The use of such designated areas shall be on a first-come, first-serve basis
and shall be limited to no more than one (1) week in each thirty (30) day period
subject to availability,
12, Application may be made to and all permits issued by the Department of
Public Works, 1685 Main Street (City Hall).
13, Applicant shall keep a copy of the permit available for inspection by any
officer or employee of the City bf Santa Monica during the applicant's pre-
sence on the Ma11,
14, The use of sound amplification equipment is prohibited,
