The Tentative Map was filed on August 1, 1874 and is therefore n.ot affected by the. moratorium on condom:iraium conversions imposed on September 17, 174 being one of the two applications which were in _process at the time of the. City Cotimcil actionm Back~rou.nd 'I''he applicants own a 7 unit apartment building at g58 iSth Street in the R2 District Urhich they built in i96~e T'aese units are all 2 bedroom, 2 baths units ~;~ritr two parking spaces per unit, 14 spaces in. all of which 7 are tandem. The building height is 2 stories over subtarranean garages and each unit is approximately 1400 sa. ft, in area. _ 1 _ Appeal, 1'enta-tive Tract 32455, Condominium Conve,-rsion The building meets the code requirements for condominium .conversion in that it is 3 years old and has more than the mini- rum 11 parking spaces. , The Tentative Map was filed. on August l and set for Public Hearing on -0ctober 7th, continued to November 4th for clarification of the effect of the moratorium and. then to December 2nd. for con- sideration. On December 2nd the Planning commission, with one seat vacant, failed to approve ox deny the application by a 3 to 3 vote. Under Plansiing Commission rules at least. 4 affirmative votes. are required. to take action and an application not approved is deemed to be denied. On December 17th .the applicant appealed ar_d'on January 5, 1975 requested that the appeal be postponed until.. March. The matter was not opposed by anyone from the public. at any of the meetings and the tenants of the building had been;notified of the Hearing; in addition o the surrounding property owners... ' Alternatives Section 9314 of Chapter 3, Article IX of the Municipal Code provides that following a Hearing the City Council may overrule or modify any ruling or determination of the Planning Commission in regard to any subdivision. The City Council, therefore, has - 2 _ Appeal,. Tentative Tract j2455, Condominium Conversion several alternatives avai_1ab1e including approving, disapproving or coed-itionally approving the applications. Alternative 1. Approval of Application_ Pros include consistency of action in that the applica- tion meets all the requirements for a conversion set forth in the condominium ordinance, exceeds the required parking by providing 2 spaces per unit and was filed for consideration .prior to the enactment of the moratoriums Cons. include the overruling of the Planning Commission, although the Commission's action was not clearly decisive due to one vacancy at the time; the approval-of a conversion during the moratorium period even 'though the application is clearly- exempt; ,.and the possibility ihat the building might not meet the standards of a future conversion ordinance. Alternative 2. D;sapproval of Application Pros include mair_taining the effectiveness of the mora- Corium even though the subject application is exempt therefrom and ~ ~~~ is presently before the Cotmcil only .due to unavailable delays which have precluded its consideration earlier. Cons include the disapproval of an applicaiion_ c•rhich met the legal requirement at the time of its riling and which ua~s tvn= opposed by the pub:!ic or tenants of the building _. - 3 - Appeal, Tentative Tract 32455, Condominium Conversion Alternative 3. Conditional Approval of Application Fros and cons include those set. forth in the. first alternative with the addition of conditions to mitigate negative effects or improve the favorable aspects. Recommendation Inasmuch as the application meats or exceeds the legalre- quirements for conversion in effect at`the time of its Sil.in~., was unopposed- by eiaher the pu'olic or the tenants of the bui7_dix~ who ', are most affected.; is exempt from the provisions of the moratorium since imposed; and, but for the vacancy on the'Commission at the ; time of consideration conceivably could have been. approved, it is respectfullyszbmitted that the Honorable City Council grant the appeal apd approve Tentative Tract Map 32455 subject to the following condi$ions: 1, The installation of approved icnic smoke detection devices in each unit as-required by the Fire Marshall.., 2. The filing of an agreement by the applicar_ts that a sufficient notice will be given to tenants, not'less than`180 days,_ to permit those not wishing to participate to obtain alternate housing.
