'Phis report transmits a recommendation that the Municipal Code be amended
to implement 2<iemoranda of Understanding with United Transportation Union
regarding payments to employees for absence due to work-connected dis-
ability.
Background
The i,lemorandum of Understanding :.ith Local 178s of the United
'Pranspo-rtation Union provides for continuation of salary
for 60 days for a disability absence rather than the 90 days provided for
under Section 2104 I (8) of the Municipal Code. Therefore, to properly
implement the provisions of the Aemoranda of Understanding it is necessary
to add a sub-section to this provision that states "The number of calendar
days of a disability absence where an employee receives the. difference
between the disability payments under the iVorker's Compensation Act and
full salary may be further regulated by Memorandum(s) of Understanding
approved or adopted by the City Council. It is the intent of the City
Council that this sub-section be retroactive to July 1, 1977."
The City Council has previously amended applicable sections of the Municipal
Code to provide the flexibility of negotiating terms and ~ondrtion s o£
employment different than those appearing in the t<funicipal Code. For
example, under the sick leave provisions of the Municipal Code (Section ?104 (I))

there is a provision that maximum accumulation of sick leave days and
payment in lieu of unused days may be further regulated by resolution
of memoranda of understanding approved and adopted by the-City Council.
Recommendation
It is recommended that the City Attorney be instructed to prepare an
ordinance amending Section 2104 (8) by adding Section 2104 I (8} (b) to
insure proper implementation of the recently ratified United Transportation
Unior. Memorandum of Understanding.
