sr-052483-11eGS:SES:JAS ~~~ Council Meeting: May 24, 1983 Santa Monica, California r ~~® T0: Mayor and City Council MAY 2419@3 FROM: City Staff SUBJECT: Request to Set a Public Hearing on Proposed Changes to the Toxic Chemical Disclosure Form Introduction In accordance with the requirements of Section 53028 of the Toxic Chemical Disclosure Law, it is requested that the City Council set a public hearing on June 14, 1983,. on proposed revisions to the 1983 Toxic Chemical Disclosure Form. Background On November 3, 1981, the City Council adopted a Toxic Chemical Disclosure Ordinance. Two years of experience with the Ordinance indicates that certain revisions are necessary. Many businesses answer questions on the form inaccurately. Further, the Fire Department has requested that changes be made in the form to assist them in responding to emergency situations. Double Reporting and Form Format Presently, substances by chemical name are listed on one page and chemicals by product name are listed on another. Because of this format, businesses frequently report the same chemical twice, once on each page (see Exhibit A, present Toxic Chemical Disclosure Form). In this instance, staff cannot make an accurate assessment of the number of chemicals used. The revised Toxic Chemical Disclosure Form requires that each substance be reported by chemical name and/or product name and the t ~® 1 MAY 2 4 1993 GS:SES:JAS Council Meeting: May 24, 1983 Santa Monica, California same line (see Exhibit B, proposed Toxic Chemical Disclosure Form). This will avoid double reporting. Also, the present form draws no distinction between storage of raw chemicals and disposal of waste chemicals. To clarify methods of storage, handling, processing and disposal of chemicals, the revised form is divided into two categories of question - those about how chemicals are handled in raw form and waste form. Fire Department Recommended Changes The Fire Department needs more specific information about the quantities of chemicals disclosed for determining adequate emergency response methods. Presently, the form only asks for quantities in the following increments: less than one gallon, one to ten gallons, ten to one hundred gallons and over 100 gallons. The revised form asks that actual quantities of chemicals be specified. And, since many chemicals are measured in pounds, not gallons, a business is now required to report by appropriate unit. The Fire Department is also concerned, for emergency response purposes, if a chemical is used in manufacturing or processing, or stored for later distribution. Therefore, a questions is included on the revised form, asking whether a chemical is emitted in any form. 2 GS:SES:JAS Council Meeting: May 24, 1983 Santa Monica, California The Fire Department has reviewed the proposed revisions and concurs with the recommended change. Recommendation It is recommended that the City Council adopt the attached resolution setting a public hearing on June 14, 1983, regarding proposed changes to the 1983 Toxic Chemical Disclosure form.
