BACKGROUraD Tile Model Building Security Ordinance was developed through the combined efforts of the California Crime Prevention Officer's Association and the Attorney General's Office. Cities are specifically authorized by Penal Code Sections 14050 and 14051 to develop local security standards and regulations designed to prevent or reduce the likelihood of burglary or robbery in any building, including new single family residences, apartments, public owned buildings, commercial, and inaustrial buildings. The Model Building Security Ordinance is intended to safeguard property by incorporating crime prevention technology into building material standards. It requires minimum outdoor lighting and regulates the design and quality of materials used in doors and other points of entry into buildings. Our Police Chief, Fire Chief, and Building Officer have met and considered the provisions of the model ordinance, and recommended certain modifications to its terms. J~~ Z 6 157 PARTICULARS The Model Ordinance applies to new construction and to buildings. or structures to which additions or alterations are made that exceed twenty-five percent (25°s) of the value of the existing buildings or structuresm Ci y Staff recommends that a ten percent (l0o)standard be used. The applicability of the ordinance to existing structures is perhaps its most controversial section, and should be addressed in detail at the public hearing, City Staff also recommends that the Model Ordinance. be modified to specify that security methods shall not create a hazard to life by obstructing emergency exit facilities nor supercede safety requirements contained in the Building or Fire Codes, such as those relative to door latches or locks. The ordinance would be enforced by the Building Officer and the Police Department. Staff would be empoorered to conduct inspections of buildings to insure compliance with the chapterp except in emergencies, inspection warrants would be required when access to buildings is refused, Violation. of the provisions of the ordinance is a misdemeanor. The Model Ordinance provides that the owner of a building may apply for a hardship exemption from the provisions of the ordinance. At the public hearing, the Council should determine which. City Agency or Commission should hear such appeals, and the standard of review to be exercised. The ordinance specifically provides- that units constructed under a common plan shall. have locks using combinations that are not interchangeable with other locks in the development. -2- It contains detailed specifications for the installation and construction of fra*_nes, jambs, strikes, and hinges. It regulates the construction of windows, sliding glass doors, and garage-type doors. The ordinance details special residential building requirements. V7ood doors must be of a specified minimum thickness; they must by equipped with double cylinder deadbolt locks that incorporate a feature preventing the key from being removed from the interior cylinder when the bolt is projected, or single cylinder deadbolt locks (this .provision added by City Staff). Doors must contain specified flush bolts, glass, and door viewers. Residential dwellings must contain prominent street numbers and identifing data. Multiple family dwellings must be adequately lit. Similiar provisions also are required of commercial dwellings. All the technical requirements specified in the Code are subjected to particular testing procedures. The P4ode1 Ordinance allows the City to take a flexible approach to alterhative methods of achieving building security that are equally effective to those specified. ALTRRNATIVES 1. The. Council may direct the City Attorney to draft an ordinance £or introduction based on the California Dlodel Building Security Ordinance, as modified by the City°s Police Chief, Fire Chief, and Building Officer, and hold a public hearing thereon. 2. The Council may direct the City Attorney to draft the ordinance, and direct that a hearing be held before a commission, such as the Planning Commission or Building and -3- ~D Safety Commission. l 3.
