SUBJECT: Acquisition of Praperty for the Cemetery
The subject property, consisting of two fifty foot
lots, is owned by two persons, as tenants in common, and is
appraised at $87,000.00. A condemnation trial is pending.
Each of the parties is represented by a separate attorney.
One party has made a settlement demand of $50,000.00 for his
one-half interest and the other has agreed to $45,000.00.
Subject to council approval, I have settled with the
party asking $45,000.00 for that amount. Settlement of the
one-half interest will avoid an extended trial.
I recommend that this settlement be approved.
