Ordinance repealing Fireworks Ordinance.
INTRODUCTION
This report transmits an ordinance repealing Ordinance
Plumber 1126 (CCS), which pef~rnits the sale of safe and sane
fireworks in the City. This matter was considered by the
Council at its November 27, 1978, meeting as Item 11A.
BACKGROUND
On May 27, 1979, the Council adopted Ordinance Number
1126, adding Chapter 7A to Article VI of the Santa Monica
Municipal Code relating to the storage, use, and sale of
safe and sane fireworks within the City. The ordinance
essentially permitted the sale and discharge of safe and
sane fireworks. within the City between June 28 and July 4
of each year, pursuant to the provisions of the .ordinance,
and not otherwise. The Council also apprmved, on May 8, 1979,
Resolution Number 5301 (CCS), which established a procedure
for the processing of permits to sell safe and sane fireworks.
At the November 27, 1979, meeting, upon receipt o£ a
report from the Fire Chief, the Council determined not to
permit the sale and discharge of safe and sane fireworks
within the City, and directed the City Attorney to prepare
an ordinance repealing the existing law. The attached ordinance
accomplishes this. Since the sale of fireworks in the City is

prohibited unless specifically authorized, adoption of the
ordinance would again make fireworks unlawful.
ALTERNATNES
The Council may introduce the ordinance, thus repealing
the present law; reject it, thus leaving the present law in
effect; or modify the existing law.
RECOMMENDATION
It is respectfully recommended that the City Council
introduce the attached ordinance for first reading.
