SUBJECT: Sales of Safe and Sane Fireworks in the City
of Santa Monica
Introduction
This report transmits the attached ordinance
for second reading and adoption which provides for the sale
of safe and sane fireworks in the City,
Background
The City Council requested this ordinance at its
meeting of April 11, 1978. The ordinance was introduced
at the June 27, 1978 City Council meeting. The attached
ordinance provides for the issuance of a license to sell,
at retail, safe and sane fireworks to those charitable organ-
izations -existing i.n the City for five years previous to the
date of application. The ordinance further requires that an
applicant must set forth the proposed location of the
fireworks stand applied for, the names, addresses and
telephone numbers of each person involved in the sale of
fireworks, a description of the special record keeping
system to be utilized to account for receipts and disbursements,
a schedule of dates and hours that the stand will be in
operation, and a fully executed indemnification and irrevocable

certificate of public liability insurance for the operations
of the stand in amounts not-less than One Million Dollars
combined single limit liability.
The ordinance further regulates the construction
of the stand and subjects it to the supervision of the
Director of the Department of Building and Safety.
Alternative Solutions
The alternatives are to adopt the attached ordinance
as submitted, or to modify the same, or not to adopt any
ordinance for the sale of safe and sane fireworks in the
City.
Recommendation
It is respectfully recommended that the City Council
introduce the attached ordinance for second reading and
adopt: the same.
