A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
EXTENDING THE UTILITY USER TAX EXEMPTION FOR CHARGES MADE FOR
GAS USED IN THE PROPULSION OFA MOTOR VEHICLE
WHEREAS, Santa Monica Municipal Code section 6.72.040(a) imposes a utility
user tax upon every person using in the City using gas that is transported and delivered
through any mains, pipes or other distribution pipeline system; and
WHEREAS, the utility. user tax is imposed at the rate of ten percent of all charges
made for such gas; and
WHEREAS, Santa, Monica Municipal Code section 6.72.040(d) excludes certain
charges from the payment of the utility user tax; and
WHEREAS, Santa Monica Municipal Code section 6.72.040(d)(4) states that all
charges made for gas used in the propulsion of a motor vehicle utilizing natural gas are
excluded from the utility user tax, but this exclusion will expire on December 31, 2010,
unless the City Council extends the exclusion by resolution.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:

SECTION 1. In accordance with Section 6.72.040(d) of the Santa Monica
Municipal Code, the City Council extends the exclusion for natural gas, which is used in
the propulsion of a motor vehicle, from the utility user tax imposed by Section
6.72.040(a) of the Santa Monica Municipal Code until such time as this Resolution is
amended or repealed.
SECTION 2. The City Clerk shall certify to the adoption of this Resolution,. and
thenceforth and thereafter the same shall be in full force and effect.
