Authorize the City Manager to negotiate and execute a construction contract with SBS Corporation in an amount not to exceed $1,632,360 including a 10% contingency for tenant improvements of the new CityTV facility. 2. Authorize the Director of Public Works to issue any necessary change orders to complete additional work within budget authority. Executive Summary CityTV is responsible for the government community cable channel of the City of Santa Monica. CityTV has been operating from a leased space at 525 Broadway, which the lease expired last year, and operations were temporarily relocated to 1717 4~h Street. In April 2010, the City purchased the building located at 1654 19~h Street as a permanent location for CityTV. The City hired Nonzero Architecture to provide design services for the new facility. The facility design is complete and is now ready for construction. A request for bids for construction services was issued and upon evaluating bids received, City staff recommends SBS Corporation to provide tenant improvements to the new CityTV facility, with a total project cost not to exceed $1,632,360. This amount includes the base bid and most items irrthe alternate bid. Background CityTV is responsible for the government community cable channel of the City of Santa Monica. The channel is funded, programmed, and operated by the City, and is available to every cable television subscriber within the City. CityTV's flagship station provides live coverage of public meetings,. news, series, and live call-in programming. CityTV is known across the country for its quality programming and innovative uses of its channel. The channel has been recognized with nine Emmy awards, and awarded a SCAN NATOA STAR Award as the best channel in the state for six of the last eight years. 1 For the last 10 years, CityTV has been operating from a leased space at 525 Broadway. In April 2009, the lease expired and operations were temporarily relocated to 1717 4th Street, First Floor. On October 29 2009, Council approved the purchase option of the lease space at 1654 19tH Street as a permanent location for CityTV. In April 2010, the property acquisition was completed. Nonzero Architecture was hired to design the new facility for CityTV: On February 23, 2010, Council approved a final modification to the Nonzero Architecture contract to include .additional design services required of the project. The facility design is complete and is now ready for construction. Discussion A Notice Inviting Bids was issued on September 15, 2010, and published in the Santa Monica Daily Press and posted on the City's website. The scope of work includes the construction of the studio and office spaces, and related improvements and upgrades. A total of 40 firms attended the pre-bid job walk held on September 29, 2010. The City. Clerk's Office received 18 sealed bids that were publicly opened by the Deputy City Clerk on October 15, 2010. The bid results are as follows: Bidder Pub Construction, Inc. J. The first and third lowest bidders, Pub Construction, Inc. and Western Group, Inc., were considered non-responsive because they did not list all of their subcontractors as required per Public Contract Code of the State of California, Section 4100. The second lowest bidder, J. Evans Construction, was not selected due to their lack of similar project experience. SBS Corporation is recommended due to their past project experience, staff experience, competitive price, and responsiveness.. Staff checked references and all reported that SBS Corporation performed very well on their projects and indicated that they would hire SBS Corporation again. Financial Impacts & Budget Actions The contract to be awarded to SBS Corporation is $1,632,360. Funds are included in the FY2010-11 budget at account 0044031.589000 - CityTV Studio-Adelphia Funds.
