A RESOLUTION OF THE COUNCIL
OF THE CITY OF SANTA MONICA SETTING FORTH CONSTRUCTION, USE,
MAINTENANCE, OCCUPANCY AND DESIGN STANDARDS FOR MOUNTAIN VIEW
MOBILEHOME PARK
WHEREAS, the California Mobilehome Parks Act {Health and Safety Code
Sections 18200 et. sec.) and its associated Regulations {Title 25 of the California Code
of Regulations Sections 1000 et. sec.) provide a comprehensive set of regulations
governing the construction, use, maintenance, occupancy and design of mobilehome
parks; and
WHEREAS, the Mobilehome Parks Act applies to every mobilehome park within
California, except parks owned, operated, and maintained by a governmental agency;
and
WHEREAS, Mountain View Mobilehome Park is a mobilehome park within the
City of Santa Monica; and
WHEREAS, the City has owned, operated, and maintained Mountain View
Mobilehome Park since 2000; and
WHEREAS, the Regulations, promulgated pursuant to the Mobilehome Parks
Act, govern the construction, maintenance, occupancy, use, and design of mobilehome
parks in order to protect the health and safety of park residents; and
WHEREAS, the City is committed to protecting the health, safety and welfare of
all of its residents, including residents in its Mobilehome Parks; and
WHEREAS, application of the substantive Mobilehome Parks Act Regulations to
Mountain View Mobilehome Park would assure protection of the health, safety, and
general welfare of all park residents.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. ADOPTION OF SUBSTANTIVE STANDARDS:
Notwithstanding California Health and Safety Code section 18303, the
substantive standards of the California Mobilehome Parks Act Regulations (Title 25 of
California Code of Regulations, Chapter 2, Article 1 Sections 1000 et. sec.), including
any successor Regulation, shall apply to any construction, use, maintenance, and
occupancy within Mountain View Mobilehome Park of the City of Santa Monica.
SECTION 2. ADMINISTRATION & ENFORCEMENT:
The substantive standards adopted in Section 1 of this Resolution shall be
administered and enforced consistent with the administrative provisions of Articles I &
VIII of the Santa Monica Municipal Code. Consistent with Santa Monica Municipal

Code Section 8.08.030, the Building Officer shall have the power to render
interpretations of the adopted substantive standards and to determine whether any
regulation is considered substantive or administrative.
SECTION 3. Any other resolution inconsistent with the provisions of this
Resolution,.to the extent of such inconsistencies and no further, is hereby repealed or
modified to that extent necessary to effect the provisions of this Resolution.
SECTION 4.The City Clerk shall certify to the adoption of this Resolution and
thereafter the same shall be in full force and effect until Mountain View Mobilehome
Park is no longer owned, operated, and maintained by the City of Santa Monica, at
which time this Resolution shall be repealed and have no further force or effect.
