(General. and Conversion Standards)
INTRODUCTIDPd
This report transmits a revised Condominium Ordinance
for second reading and adoption. The Ordinance, which concerns
standards applicable to all condominium projects and to
condominium conversions, was introduced at the May fig, 1980
Council Meeting {Stem 8L;). A corripanion ordinance containing
standards for new condominium projects will be considered for
introduction at tonight's meeting.
THE PROPOSED ORDINANCE
At the May 28, 1980 Council Meeting, the Council introduced
a revised Condominium Ordinance recommended by the Planning
Commission, with certain changes. The basic provisions of the
Ordinance are explained in the Stai'f Report accompanying the
original draft. The changes made by the City Council on May ?'$,
1980, are as folloti~rs:
1. Subsection C has been amended to indicate that the
procedures, and not the substantive provisions, or' Section 9148
of the Code, concerning coedit=ionai use permits, apply.

~. Subsection P3 has been amended to require the
subdivider to furnish each prospective buyer of a condominium
unit with a copy or the Bulld:ing condition and tiistory Report
together ~nrith the proposed CC&ti's.
3• Subsection F8 has been amended to require insulation
of all pipes for circulated 'not water, and, where feasible, of
hot water heaters.
4. Subsection t*g, relating to guarantees by the subdivider,
has been amended. Items that are dommon to all units, such
as roofing, plumbing, heating, air.-conditioning and electrical
systems, are to be guaranteed until one year elapses from the
date of the sale of the last individual unit sold. Appliances,
fixtures, and other facilities provided or installed within
individual units are to be guaranteed by the subdivider for a
period of one year from the date of close of escro~nr of each
individual unit.
5. Subsection A'13, which permits approval of condominium
conversions only if the vacancy factor of rental housing units in
the City exceeds 50 of the total rental housing inventory, has been
.redrafted to delineate its two exceptions; (1) where the Flanning
Commission determines that a new rental unit has or will be added
to the City's rental housing stock for each rental unit removed
through conversion, or (7_) where 80% of the tenants of the building
agree to purchase units and the Planning Commission determines that
no substantial dislocation of tenants will o^cu~.
ALTERNATIVES
The Council may adopt the Ordinance as introduced, make
further changes and reintroduce the Ordina~:ce, or reject it.
