sr-062480-8fCA:SS5:BB:se Council Meeting Santa Moni, California STAFF REPORT ~•~ To: Mayor and City Council ~U~ 2 ~ 99$~~ From: City Attorney Subject: Ordinance relating to construction of new multiple dwellings INTRODUCTION At the Play 27, 1980 meeting, Item 10A, the City Council directed the City Attorney to prepare an ordinance relating to construction of new multiple dwellings based on the Planning Commission's recommendation, with one addition. This report transmits the proposed ordinance for introduction at the June 24, 1980 meeting and analyzes the sections. ANALYSIS The proposed ordinance revises various sections 'of the City's Condominium law relating to construction of new multi- ple dwelling units, Sections 9108, 9109, '9.110, 9122, '9129:F1A and 9129 F4 have been amended. As describedl. in-,the staff report accompanying the introduction of the revised Condominium Law.(May 27, 1980 Item 8E),the proposed ordinance is within the City's police power and State. statutory authority over the design and im- provement of subdivisions. It is unnecessary to amend the Housing Element to effectuate standards for new construction. Sections 1,2, and 3 amend §9108, 9109, and 9110 to add a requirement to property development standards for R2, R3 and R4 districts, respectively, that certain unexcavated areas be maintained on any lots or building sites having a width greater than 49 feet. ~~gy pS,,~J ° ! ;;.yy !~67i3 ~ ~ f~all~ Section 4 amends Section 9122 to add subsection H, setting forth five requirements for approval of new cohdo- miniums, community apartments or cooperative apartments relating to energy conservation plans, access, architec- tural treatment, natural light, and insulation. Section 5 amends Section 9129 F1A and changes parking requirements for all condominiums and for apartment units based on the size of the dwelling unit. It also eliminates the existing provisions permitting tandem parking. Section 6 amends Section 9129 F4 and reduces the width and length requirements for residential parking spaces as well as the width requirement for "end stalls". ALTERNATIVES The Council may introduce the ordinance as drafted, modify it, or reject it.
