Subject: Ordinance relating to construction of new multiple
dwellings.
INTRODUCTION
This report transmits for second reading and adoption a proposed
ordinance containing standards for new multiple dwelling projects.
BACKGROUND
This ordinance was introduced by the Council as Item 8F at its
July'1,1980 meeting, continued from its June 24,1980 meeting. The
basic provisions of the ordinance are explained in the staff report
accompanying the introduction of the ordinance. The changes made by
the City Council of July 1,1980 are as follows:
1. Section 9108B9,9109B9,and 9110B10 of the Code are amended
to permit consideration of variances from the unexcavated area re-
quirement in order to allow for passive and active solar applications,
2. Section 9108B9109B and 9110B are amended to add sections
9108B10,9109B10,9110B11 to make the standardaa~of Section 9122(x)(2)
(3)(4)&(5), referring to access, architectural treatment, natural
light ventilation, and insulation, applicable to new construction of
all multiple dwellings.
3. Section 9122x(1) has been amended to require the energy con-
servation plan to include an estimate of the impact of the project
on energy usage in adjacent properties.
4, Section 9122x(5) has been amended to require insulation.^for
all pipes for circulated hot water and for all hot water heaters,

5. A new section 7 has been added to the ordinance deleting
Section 9122(F)(9)(10)&(11) and amending Section 9122 (E) to add sub-
sections(4)(5)and(6). These sections require the CC&R's to include.
particular guarantees by the subdivider and aggreements by the owners
and will apply to all condominium projects upon adoption of this
ordinance.
6. The sections governing inconsistencies,;severability and the
mechanics of passage of the ordinance are renumbered accordingly.
RECOMMENDATIONS
It is respectfully recommended that the Council adopt this or-
dinance setting forth standards for construction of new multiple
dwelling units.
