SUBJECT: Modification of Ordinance No. 1127
INTRODUCTION
At the City. Council meeting of February 25, 1980, City
Council by unanimous vote approved a Joint Resolution with
the Rent Control Board. Section 5 of this Joint Resolution
instructed the City Attorney and Rent Control Administrator to
draft appropriate modifications of Ordinance _1127 for the
purpose of facilitating the goals of the Joint Resolution.
This staff report transmits the appropriate re-drafted ordinance
(in emergency and regular forms) to the City Council for intro-
duction and subsequent adoption.
BACKGROUND
The Rent Control Charter Amendment was passed on April 10,
1979. Since then there have been some difficulties harmonizing
the operations of the Rent Control Board and Law with other City
functions. Those difficulties are more specifically outlined in
the previous staff report accompanying the Joint Resolution.
This report outlines briefly what the revisions of Ordinance
1127 do.
Section 4603 provides that new permits or applications to
demolish or convert shall not be granted until the property owner
has secured appropriate approval from the Rent Board.
Section 4604 clarifies that the Rent Control Board has the
authority to make the determination with regard to vested rights

status and eliminates the potentiality for conflict between a
City Council imposed vested rights standard and a Rent Control
Board vested rights standard.
Section 4.606 clarifies that control over financial,
personnel and purchasing affairs of the Board lies with the Rent
Control Administration rather than the City Manager and City
Council.
Sections 4607 and 4608 implement this general philosophy
that the responsibility for Rent Control personnel and budgetary
matters lies with the Board.
Section 4610 merely formalizes what has previously been
understood, that there would be cooperation between other City
departments and the Rent Control Board.
Section 4611 places full responsibility for Rent Control
legal work with the Rent Control Board and permits and requires
the Rent Control Board to hire and administer its own legal staff.
The other Sections are substantially similar to those in the
existing Ordinance 1127.
ALTERNATIVES
The alternatives are either to adopt the Ordinance, to
modify it, or to fail to adopt it and rely on the current
Ordinance 1127.
RECOMMENDATION
It is hereby recommended that the City Council adopt the
Ordinance as drafted.
