Condominium, 1031 - 18th Street, R2, Gwo Rong Ueng
Introduction
This report transmits an appeal from the Planning Commission's
action on a Tentative Tract Map for a subdivision for condo-
minium purposes.
Background
On April 2, 1979 the Planning Commission failed to take action
on a Tentative Tract Map for a six unit condominium project at
1031 - 18th Street in the R2 District. Under the State Map Act
a Tentative Tract Map upon which the Planning Commission does
not take action within 50 days is deemed approved. As the
proposed project has been a matter of substantial controversy
over removal of an existing tree, and the effect of the auto-
matic approval is to allow the project to be built as proposed
including removal of the tree, Councilman Pieter van den Steen-
hoven has appealed the matter to the City Council.
Inasmuch as the appeal is by other than the subdivider, the
City Council must first make a determination as to whether the
appeal should be heard and if so set a date for the public
hearing within 30 days of the date of the appeal. The only
regular Council meeting scheduled within the 30 day period falls
on April 24th.

Alternatives
The City Council may elect to hear the appeal and set the
matter for public hearing on-April 24th or determine that
the appeal should not be heard and allow the automatic ap-
proval to stand.
Recommendation
Inasmuch as no conclusive decision was reached by the Planning
Commission and discussion of the merits of an appeal may be as
extensive as the hearing itself but less satisfactory, it is
respectfully recommended that the appeal be set for public
hearing on April 24, 1979.
