sr-102781-8c~-G OvT 2 7 1981 CA:RMM:SSS City Council Meeting 10-27-81 Santa Monica, California STAFF REPORT To: Mayor and City Council From: City Attorney Subject: Ordinance Abolishing License Review Board and Establishing Procedures for License Appeals On January 27,1981, the City Council directed the City Attorney to prepare an ordinance abolishing the License Review Board and creating an alternative administrative procedure for appeals from decisions of various agencies. The accompanying ordinance is presented in response to the City Council's direction. The License Review Board (LRB) was established in August, 1974, by Ordinance Number 968 (CCS), codified as Municipal Code Sections 6124-6126. It is constituted of five department heads and the City Clerk and decides appeals involving business licenses and other permits. Decisions of the LRB may be appealed to the City Council. In the staff report of January 27, 1981, the City Attorney and City Manager recommended that the LRB be abolished and replaced by a single, legally trained person. The change was recommended because the LRB was regarded as cumbersome, expensive, and lacking legal skills necessary to handle complex matters. OCT 2 7 1981 The accompanying ordinance amends Municipal Code Sections 6124-6126 to provide for an appeal to a Hearing Examiner in cases involving. business licenses and other permits. The License Review Board is abolished, and references to it in the Municipal Code are deemed to refer to the Hearing Examiner.
