Background On March 13, 1979, (item 6Q)-the City Council entered into contract no. 3158 with the Santartonica Olympic Shooting Club for the use of the t~1unicipal Rifle Range at 1904 Stewart Street. That contract restricted the use of the Rifle Range to the following hours: 3. Use of Premises. g~ "The use of the Range shall be limited to Monday and Thursday evenings from 7:00 p.m. until 10:00 p.m., addi- tionally, the Range may be used up to a total of six (6) mornings per year to take place on weekends. The hours will be from 8:00 a.m. until 2:00 p.m., with the days alternating between Saturday and Sunday. These mornings will be for the purpose of conducting National Rifle Association registered and/or approved tournaments." For the privilege of using the facility the Olympic Shooting Glub is maintain- ing the facility as well as paying the City of Santa Monica under the contract as follows: /d ~~G 1 1 9979 T0: Mayor and City Ca :il -2- Noy >er 29, 1979 2. Rent. "Club agrees to pay to City....the sum of fifty dollars ($50.00) annually and an additional amount of ten percent (10%) of all income above five hundred dollars (.$500.00) to a gross aggregate amount of two thousand dollars (_$2,000.00) at which time they will pay the Gity ninety-five percent (95%) above the two thousand dollar ($2,000.00) amount." On September 23, 1979 the Santa Monica Olympic Shooting Club submitted a request for expanded use of weekend hours during which they will only fire air rifles and air pistols. Regular rifles or pistols will not be fired during the expanded hours. The request which changes the use from six (5) weekend days to fifty-two (52) weekend days is reflected below: Present hours Monday 7:00 p.m. to 10:00 p.m. Regular rifle fire only. Tuesday Closed. Wednesday Closed. Thursday 7:00 p.m. to 10:00 p.m. Regular rifle fire only. Friday Closed. Saturday Three per year. Must not be the same weekend as Sunday use. 8:00 a.m. to 2:00 p.m. Regular rifle fire only. Sunday Three per year. Must not be the same weekend as Saturday use.. 8:00 a.m. to 2:00 p.m. Regular rifle fire only. Proposed hours Monday 7:00 p.m. to 10:00 p.m. Regular rifle fire only. Tuesday Closed. Saturday Every Staurday from 8:00 to 10:00 p.m. for air rifle and air pistol fire. No regular rifle fire. Three per year from 8:00 a.m. to 2:00 p.m. for regular rifle fire. Must not be the same weekend as Sunday use. Sunday Every Sunday from 8:00 a.m. to 10:00 p.m. for air rifle and air pistol fire. No regular rifle fire. Three per year from 8:00 a.m. to 2:00 p.m. for regular rifle fire. Traffic will not be affected and there will not bean adverse affect from traffic on the neighborhood. Parking is adequate for the expanded use. Prior to the closing of the Range and when staff was seeking a solution to the noise problem, air rifles were tested for noise production. Staff found there to be no audible report from the air guns. in any of the areas outside the Rifle Range. There, staff feels that this request is reasonable and that there will not be any disturbance to the surrounding neighborhood with the use of these expanded hours for air guns only. Staff sees no need to modify the .terms of the contract regarding rent,. as the expanded hours will increase the Club's opportunity to pay 10% of the income above $500.00 to the City. Alternatives 1. Council may approve the request and authorize the additional hours of use for air guns only, and instruct the City Attorney to amend the lease as proposed. Recommendation Staff recommends alternative no. 1 that Council approve the request by the Santa Monica Olympic Shooting Club and authorize the additional hours of use for air guns only, and instruct the City Attorney to amend the lease as proposed. At this meeting, Mr. John Malone, President of the Santa Monica Olympic Shooting Club, addressed the Commission with regard to amending the present lease agree- ment between the City of Santa Monica and the Olympic Shooting Club, to allow for weekend use of the range, restricting this use to air rifles and air pistols only. Following discussion Mr. Naylor moved to recommend approval of the extension as proposed by the Olympic Shooting Club. The motion was seconded by Mr. Durst and carried unanimously.
