Kennedy, City Engineer SUBJECT: Third Street Mall - Architect's Services During Construction As you know, it is our normal procedure to include in our design contracts with Architect-Engineer firms a provision for certain services to be rendered during construction of the project. Such services include consultation and advice on colors, patterns, and rraterials (when a choice is per- mitted under the specifications, as well as periodic in- spection and visits to the site during construction. Due to the unique circumstances involved in the design contract for the Mall, however, no mention of such services was in- cluded in said contract. Since the primary appeal of the Mall is its aesthetic and architectural treatment, and since Charles Luckman Associ- ates are responsible for the development of these features of the Mall, it certainly is in the best interest of the City to retain their services during the construction phase Accordingly, Charles Luckman Associates, at the request of this office, has submitted a proposal for performing the services referred to above. A copy of their letter proposal is attached hereto. The architect°s proposal states that the fee for these services iaill be not more than $3,97x• An allowance of $4,000 for this purpose has been provided in the incidental expenses for this project. Kennedy City Engineer Re: Professional Services, 3rd Street Mall Dear Mr, Kennedy: In response to your request, CLA proposes to provide professional services for the 3rd Street Pedestrian Mall during the period of construction, as follows: 1, Check and approve samples, schedules, shop drawings and other submissions for conformance with the design concept of the Project and for compliance with the information given by the Contract Documents, 2. Selection and approval of paint colors and material samples.. Such selection shall be subject to final approval by OWNER. 3, Issuance of Bulletins and Change Orders when requested by OWNER. 4, CLA will make periodic visits to the site to observe the progress and quality of the work and to determine in general if the work is proceeding in accordance with the Contract Documents. CLA will not be required to make exhaustive or continuous on-site inspections to 'check the quality or quantity of the work and CLA will not be responsible for the Contractors' failure to carry out the construction work in accordance with the Contract Documents. Kennedy -2- April l9, 1965 During such visits and on the basis of CLAYS observations while at the site, CLA will keep the OWNER informed of the progress of the work, will endeavor to guard the OWNER against defects and deficiencies in the work of the Contractor, 5. Final inspection of the project when the Contractor indicates that the job is complete. ^1 he performance of these services shall in no way negate the Con- t-racto-r~s responsibility for carrying out all the terms and conditions o~ the General Contract on each project. These construction obser- vation services shall relate only to construction work performed by the General Contractor as described in the Contract Documents. For providing the professional services described herein, CLA shall be paid a total fee of three-thousand nine-hundred and seventy-six dollars (~3, 976. 00). CLA will invoice the OWNER on a monthly basis in proportion to the progress of the construction work. No deduction shall be made from CLAYS compensation on account of penalty, liqui- dated damages or other sums withheld from payments to the Contractor. If the project is suspended or terminated by the OWNER before com- pleted, CLA shall be paid to date of such suspension or termination based upon the degree of completion of the construction. CLA warrants that the professional services to be furnished under this Agreement shall be performed by, or under the direction of, licensed Architects or Engineers. 7i the above conditions are satisfactory, please signify your approval by signing as noted below and return one copy to CLA for our records.
