Kennedy, City Engineer Decorative Fountain - Third Street Mall Plans for the subject fountain have been received from Charles Luekman Associates. This fountain, as you know, is to be located in the 1200 block, approximately 134 feet south of Wilshire Boulevard. Construction on the Mall project has reached the point where authority to construct the fountain must be obtained if construction on the Mall itself is not to be delayed. It appears that the most practical way to accomplish the construction of the fountain is to have the Mall con- tractor construct the same under the terms of a Change Order to the contract. The work covered by the Change Order would not include the casting or placement of the sculptured panels. This latter work would be the subject of a Purchase Order Contract when more detailed informa- tion is available. A proposal of $25,965 for constructing the fountain has been received from W. J. Shirley, the Mall contractor. The total estimated cost of the fountain, including sculptor's fee, casting and placement of sculpture, architect's fee, and contingencies, is $49,465. Subject: Decorative Fountain - Third Street Mall It is recommended that the City Council be requested to authorize the following: (1} Issuance of a Change Order covering the construction of the decorative fountain, at a total cost of not to exceed $25,965, with no extension of the contract completion time. However, the Change Order will provide that, should there be a delay beyond the control of the contractor in obtain- ing some of the required materials, the time to complete the fountain only will be extended accordingly. Such extension will not affect the completion date of the basic Mall contract.
