Kennedy, City Engineer °.ESCTSTECT: Third Street Pedestrian Mall As you know, work on the subject project has been seriously curtailed as a result of the current strike of t}perating Engineers. .The only work of any cansequence now in progress is the forming of appraximatsly eight planters, two pools, and one platform in the 13t3o block and one glat- form in the 12(~ block. Pio other major work can be ac~om- plished until the strike is ended and exoavation operations oan be resumed. The Administration proposes to perform sufficient excavation operations to permit him to continua with the fox°riing and pouring of the remaining planters and pools. A Change brdet° wi11 be necessary to delete this portion of the work from the basic contract. 'The City Attorney°s of#'ice has ruled that there is no le;al objection to the City performing; this work, provided that the Boat thereof is deleted from the monies paid to the contractor. O'Melveny and Myers, our legal cansultants an this pro,jsct, have concurred in this ruling. This office and the contractor have agreed that the following prices {prices which would be deducted fron the payment due to the contractor) fairly represent the eost of the work proposed to bs performed by the City: {1) 401 per cubic yard for excavation and rough r~rading. ~afork to he limited to excavating grad loading into the contractor°s trucks. {2) ~1CJ.40 for each planter to bs excavated.
