SUBJECT: General Plan Amendment Number 07 to Add Policy 1.8.9 to
special Office District section of the Land Use and
circulation Elements
INTRODUCTION
This proposed General Plan Amendment Number 07 would add language
to the special Office District section of the Land Use and
Circulation Elements to clarify city policy regarding the
transfer of an approved hotel use from Colorado Place Phase II to
Colorado Place Phase III through a development agreement process.
The purpose of the transfer is to locate the hotel use at a site
which is more compatible with the surrounding neighborhood, land
uses, and development intensities.
Staff recommendation is to conduct a public hearing, and approve
the proposed amendment.
PROPOSED AMENDMENT
The proposed amendment would create Policy 1. 8.9 in the "Special
Office District" section of the Land Use Element of the General
Plan. The proposed amendment reads as follows:
One ninety-six foot high hotel having floor area not to
exceed 270,000 square feet may be permitted through a
development agreement process at 2000-2224 Colorado Avenue.
The purpose of this amendment is to clarify that development I' A

The pending Amendment Number Four to the Colorado Place Ltd.
Development Agreement involves the transfer of the hotel use
approved in the existing Agreement to a different site (Colorado
Place Phase III) and is the subject of a new proposed Agreement.
The proposed Land Use Element amendment would clarify that this
specific transfer is permissible.
staff had previously developed a more general amendment regarding
transfer of development rights created by development agreements,
but at its March 11, 1987 meeting, the Planning commission
rej ected that proposed amendment.
staff has developed General
Plan Amendment Number 07 to address the concerns raised at the
March 11th meeting by establishing a very limited policy which is
specific to the Colorado Place projects.
At its meeting on August 24, 1987 the Planning Commission
unanimously recommended adoption of the proposed General Plan
Amendment.
The proposed amendment is necessary to explicitly state in the
General Plan that the hotel transfer may occur, subject to
Planning Commission and Council review and approval through the
development agreement process. The motivation for the transfer
is concern on the part of the City and other interested persons,
including neighborhood residents, about the compatibility of the
hotel use with the surrounding neighborhood at the Phase II site.

The Phase III site is not located adjacent to residential
neighborhoods.
MUNICIPAL CODE AND GENERAL PLAN CONFORMANCE
The proposed project is itself an amendment to the General Plan
which is consistent with the existing Municipal Code and which is
consistent with the General Plan. The Code presently provides
for development agreements (section 9800) . The proposed
amendment would reference an existing and a pending development
agreement, and would explicitly require that the hotel use
described by the amendment could only be permitted through the
development agreement process.
The amendment is consistent with several specific objectives and
policies of the Land Use Element, including Section L 1 which
seeks to insure neighborhood and citizen participation in the
city planning process and the protection of the quality of life
in all residential neighborhoods; Section 1.2 which seeks to
insure compatibility of adjacent land uses with particular
concern for protecting residential neighborhoods; and Section 3.2
which seeks to protect the scale and character of residential
neighborhoods adjacent to commercial areas.
CEQA STATUS
The proposed amendment, by virtue of being in the nature of
clarification to existing law relating to transfer of an approved
use from one site to a nearby site, has been determined to be
exempt from CEQA under a General Rule Exemption pursuant to

Article III section 1 of the City CEQA Guidelines. The hotel use
at the Colorado Place Phase III site was analyzed in the EIR for
that project.
BUDGET/FINANCIAL IMPACT
Adoption of the recommendations of this report will not result in
any bUdget/financial impacts.
RECOMMENDATION
It is respectfully recommended that the City Council adopt a
resolution (Attachment A) approving the proposed amendment.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA ADOPTING AN AMENDMENT TO
THE SPECIAL OFFICE DISTRICT SECTION OF
THE LAND USE AND CIRCULATION ELEMENTS OF
THE GENERAL PLAN REGARDING TRANSFER OF
A HOTEL USE FROM COLORADO PLACE PHASE II
TO COLORADO PLACE PHASE III
WHEREAS, the City of Santa Monica adopted its existing
Land Use and Circulation Elements on October 23, 1984; and
WHEREAS, the Special Office District section of said
Elements contains policies concerning allowable uses and
development standards for such uses: and
WHEREAS, the approved development agreement between the
City and Colorado Place Limited allows for a hotel use: and
WHEREAS, it is advisable to relocate this hotel use to a
new site which is not ~djacent to residential neighborhoods and
is closer to freeway access, and the contemplated site which is
the subject of a proposed development agreement between the city
and Sopac Properties, Inc. is such a site; and
WHEREAS, this relocation-- is consistent with several
objectives and policies of the city's Land Use Element, including
Section 1.1 which seeks to ensure neighborhood and citizen
participation in the City planning process and the protection of
the quality of life in all residential neighborhoods, Section 1.2
which seeks to ensure compatibility of adjacent land uses with

particular concern for protecting residential neighborhoods, and
Section 3.2 which seeks to protect the scale and character of
residential neighborhoods adjacent to commercial areas; and
WHEREAS, the City staff has prepared a recommended
General Plan amendment to the special Office District section of
the Land Use and Circulation Elements which would provide for the
relocation of the hotel use specifically authorized in the
development agreement pertaining to Colorado Place Phase II to
the site which is the subject of a proposed development agreement
for Colorado Place Phase III, and this General Plan amendment was
the subject of a Public Hearing before the Planning Commission on
August 10, 1987, affording any interested person an opportunity
to comment on the matter; and
WHEREAS, the Planning Commission unanimously recommended
approval of the General Plan amendment; and
WHEREAS, on September 22, 1987 the City Council conducted
a Public Hearing on the General P~an amendment,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The document entitled Amendment Number 07 to
Land Use and Circulation Elements Regarding Special Office
District, attached hereto as Exhibit A and incorporated herein by
this reference, is hereby approved and adopted as an amendment to
the Land Use and CirCUlation Elements of the City of Santa
Monica.

SECTION 2. The city Clerk shall certify to the adoption
of this Resolution, and thenceforth and thereafter the same shall
be in full force and effect.
