This ciair~l arises out of an incident w'rrich occurred on
July 30, 1980 on Beverly Drive north of Pico Boulevard in Los
Angeles.
Claimant alleges that Santa ri4onica Alunicipal Bus
#624069 was travelling southbound in the number one lane when
the driver without signalling or other warning abruptly changecz
to tiie nur,•~ber two lane where the claimant was also travelling
southbound. Two independent witnesses have verified clairant's
version of the cause of the accident. Because of the bus driver's
evident negligence in attempting to negotiate a lane change without
proper clearance, the right front side of tyre bus collided oaith
the left front side of the claimant's vehicle. As a resait of
tixe impact, plaintiff sustained both physical injuries and damage
to her 1976 Tiustang.
According to medical reports,. claimant sastained a
severe sprain and spastic i_nflaramation of the muscles. Ciairnant's
rredical bills totalled $2,060.00, she had a loss of earnings of
$565.25. The property dar~lage to claimant's car was $860.04.
Claimant's attorney ixad demanded $9,500.00 in settlement
of this claim. After verifying liability, medical reports and

bills, loss of earnings, and property damage, our claims adjuster
offered $6,560.29, subject to approval, in order to settle this
claim. (See attached sheet.)
Deputy City Attorney, Yvonne I3instock, did not approve
$6,560.00 to settle this claim and entered into numerous settle-
ment negotiation conferences with claimant's attorney. Claimant
has agreed to accept $3,500.00 in full settlement of her claim.
In view of the ii ability on the part of the City and
the property damage and. personal injury sustained by claimant,
it is our recornr:~endation that the Council authorize payment or
$3,500..00 to settle this claim.
