AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
APPROVING THE DEVELOPMENT AGREEMENT BETWEEN THE CITY OF
SANTA MONICA, A MUNICIPAL CORPORATION AND AGENSYS, INC., A
CALIFORNIA CORPORATION
WHEREAS, on May 13, 2010, Agensys, Inc., a California Corporation,
submitted an application for a development agreement for a new biotechnology
research and development and light manufacturing facility with ancillary
administrative offices, meetings rooms, and employee amenities including a
cafeteria open to the public during lunchtime hours; and
WHEREAS, a Mitigated Negative Declaration has been prepared which
analyzes the environmental effects of the development agreement; and
WHEREAS, on September 14, 2010, the City Council adopted a resolution
approving the Mitigated Negative Declaration; and
WHEREAS, the development agreement is consis#ent with the General
Plan, as detailed in the accompanying City Council staff report prepared for this
proposed project and the exhibits thereto,

SECTfON 3. Any provision of the Santa Konica Municipal Code ar
appendices thereto, inconsistent with the provisions of #his Ordinance, to the

extent of such inconsistencies and no further, are hereby repealed or modified to
that extent necessary to effect the provisions of this C}rdinance.
