Recreation and Parks Commission

Staff recommends that the City Council introduce for first reading the attached
ordinance amending Municipal Code section 2.12.155 to establish a second
Commissioner Emeritus position on the Recreation and Parks Commission.
Executive Summary
The. proposed ordinance creates another Commissioner Emeritus position on the
Recreation and Parks Commission in response to Council direction. As proposed, this
ordinance will allow the City Council, based upon recommendations from the Recreation
and Parks Commission, to appoint a Commissioner Emeritus as a non-voting
Commission member. To be appointed, the person will be required to have served on
the Recreation and Parks Commission- for at least two terms. The term for the
Commissioner Emeritus position would be two years and persons may serve up to two
consecutive terms.
Background
The Recreation and Parks Commission is established in the City Charter and is
comprised of seven members appointed by the City Council. Additionally the Municipal
Code includes code section 2.12.150 related to the Commission's responsibilities. On
Cctober 14, 2008, the City Council established one Commissioner Emeritus position on
the Recreation and Parks Commission. To be appointed, the person must have served
on the Recreation and Parks Commission for at least two terms. The appointment is for
two years with the ability to serve up to two consecutive terms. Qn July 13 2010, in
response to a request from the Recreation and Parks Commission, the City Council
expressed a desire to create a second emeritus commissioner position on the
Recreation and Parks Commission and directed staff to return to the Council with an
ordinance for its establishment.
Discussion
Precedent exists for multiple emeritus commissioners on both the Commission on the
Status of Women {COSW) and the Commission for the Senior Community (CSC) in
order to recognize the contributions of long-standing commissioners and provide
continuity regarding Commission issues. In both cases up to three emeritus positions
may be appointed by City Council upon recommendations of the Commission. To be
appointed, the person must have served two full terms as a commissioner and must be
a city resident. The emeritus commissioners are non-voting members but may
represent the Commission at community and other activities as directed by the
Commission. Commissioner emeritus positions have a two year term and with a
maximum of two consecutive terms and shall not be eligible to serve simultaneously as
a voting member on another City Commission. It is recommended that the proposed
second emeritus position on the Recreation and Parks Commission mirror these
requirements.

There is no fiscal impact associated with this recommendation.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA ADDING SECTION 2.12.155 TO ADD A POSITION OF
COMMISSIONER EMERITUS ON THE RECREATION AND PARKS COMMISSION
WHEREAS, the Recreation and Parks Commission has recommended the
creation of the emeritus position for the commission; and
WHEREAS, the City Council has considered this recommendation and has
determined that creation of the emeritus position will assist the commission in its service
to the community;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Santa Monica Municipal Code Section 2.12.155 is hereby added to
the Santa Monica Municipal Code to read as follows:
2.12.155 Commissioner(s) Emeritus.
The City Council may appoint up to two
Commissioners Emeritus who may serve on the Commission
for Recreation and Parks ("Commission"). The appointment

shall be based upon the recommendations of the
Commission. To be eligible for appointment, a person must
have served two full terms as a Commissioner on the
Commission and must be a resident within the City. The
Commissioner Emeritus shall be a nonvoting member of the
Commission,. may represent the Commission at community
and other functions as directed by the- Commission, may
serve on Commission committees and shall abide by the
bylaws of the Commission. The term for the Commissioner
Emeritus shall be two years, and the Commissioner
Emeritus may serve a maximum of two consecutive terms.
The Commissioner Emeritus shall not be eligible to serve
simultaneously as a voting member on another City
Commission.
SECTION 2. Any provision of the Santa Monica Municipal Code or appendices
thereto inconsistent with the provisions of this Ordinance, to the extent of such
inconsistencies and no further, is hereby repealed or modified to that extent necessary
to effect the provisions of this Ordinance.
SECTION 3. If any section, subsection, sentence, clause, or phrase of this
Ordinance is for any reason held to be invalid or unconstitutional by a decision of any
court of competent jurisdiction, such decision shall not affect the validity of the
remaining portions of this Ordinance. The City Council hereby declares that it would
have passed this Ordinance and each and every section, subsection, sentence, clause,

or phrase not declared invalid or unconstitutional without regard to whether any portion
of the ordinance would be subsequently declared invalid or unconstitutional.
SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage
of this Ordinance. The City Clerk shall cause the same to be published once in the
official newspaper within 15 days after its adoption. This Ordinance shall become
effective 30 days from its adoption.
