Introduction:
This is an appeal from the determination of the City
Planning Commission in denying an application to convert a
23 unit Apartment House into a 23 unit condominium project.
Back~rou_nd:
The applicant's purpose is to convert the 23 unit apart-
ment building at 1255 Tenth Street into a 23 unit condominium
project. The building is 3 years old and contains 37 parking
spaces, a ratio of 1/z to 1. 12 oz the spaces are tandem spaces.
iVo limitation as to residency is contemplated. Following a
Public Hearing on the matter on February 4th, the Planning
Commission determined that the application should. be denied
in that the conversion would concievably result in displacement
of present residents and increased monthly housing costs.~e
vote to deny Tags 5 to 2. The applicant now a ~ ~"

Municipal Code provides that the City Council may overrule or
modify any ruling or determination of the Planning Commission

in regard to arm subdivision and may make such findings as are
not inconsistent. with the provisions of the Subdivision Map.
Act or Subdivsion Ordinance. The CitJ Council is free, there-
fore, to sustain the determination of the Planning Commission
if it concurs ~~rith the findings of the Commission and. finds..
substantial grounds for denial, or reverse the Commission
findings if it .believes that the Commission findings consti-
tuted insufficient grounds for denying the application::
