SUBJECT: Setting a Public Hearing for November 11, 1980 to Hear
Protests Regarding the Street Lighting on Stanford
Street between Washington and Montana and to Confirm
the Assessments
Introduction
The provisions of the Improvement Act of 1911, specifically Section 5362,
provides that prior to confirmation of assessments all persons interested
in the work or in the assessment will be heard by the City Council.

On November 27, 1979, the City Council adopted Resolution No. 5448 (Item 7B)
which found the public convenience and necessity required construction
of street lighting on Stanford Street between Washington Avenue and
Montana Avenue, and Resolution No. 5449 (Item 7C), the Resolution of
Intention. The street lighting work is now completed and the assessment
has been filed with the City Clerk. It is necessary now to hold a
public hearing to hear protests regarding the work and the correctness
of the assessment. The assessment shall be provided to the City Council
at the November 11, 1980 meeting.
Recommendation
It is recommended the City Council set a public hearing for November 11, 1980.

SUBJECT: Filing Assessment
Your schedule in regard to the above subject requests the
City Clerk to publish a notice of filing assessment on
October 22, and 24, 1980 (copy attached). I drafted a
notice. However, I am not comfortable about copying the
wording from a 1974 notice if there is a thane
that this
is not the same kind of situation. I also like to keep
notices simple and brief and I haven't been able to do
that with this one. Further; I don't know the regulations
relating to this particular assessment. I can't determine
whether the publication should hold Resolution No. 5448 or
5449 mentioned in your staff report of October 2nd or
Resolution No. 5423 mentioned in the Assessment No. 382.
In view of the October 22nd publication date, I would
appreciated hearing from you as soon as possible with
your approval of the notice or a notice you have drafted
that fills the needs in this case.
