Street Lighting District: Sunset Avenue between
Seventeenth Street and Dewey Street
Introduction
This report requests that City Council approve the assessment
diagram, hold a public hearing on .the confirmation of
assessments, and hear any protests concerning the installation of
a high-pressure sodium street lighting district on Sunset Avenue
between Seventeenth Street and Dewey Street.
Background
The City Clerk set a public hearing for February 9, 1982, to hear
protests and confirm assessments on the street lighting district
on Sunset Avenue bet~xeen Seventeenth Street and Dewey Street.
The street lighting work is now complete and the assessment has
been filed with the City Clerk. It is now necessary to approve
the assessment diagram and to hold the public hearing to hear
protests regarding the work and the correctness of the
assessment.
On November 24, 1981, staff presented a street lighting
assessment for confirmation by Council. At that time, Council
requested staff to prepare a report which described how the cost
of installing street lights is assessed to property owners.

After a street lighting petition is requested, staff prepares a
map of the improvement area tentatively indicating the location
of street lights. In residential areas,- the map is prepared in a
Z-pattern. For example:

As the diagram indicates, a light is installed on each of the
side streets. The names of the property owners of Parcels 1 and
6 who do not face the main block are listed on the petition. The
Z-pattern is designed so that the cross streets will also be lit
as the various blocks get street lighting. If the Z-pattern were
not used under the present policy, the cross streets would
probably never be lit due to the high cost of street lighting.
The assessment would be spread as follows:
Lots 1 and 6 20% x side footage x 1/2 cost/foot
Lots 2 and 5 50% x front footage x cost/foot
Lots 3 and 4 (50% x front footage x cost/foot) +
(20% x side footaoe x 1/2 cost/foot)
The theory behind 20% of l/2 of the cost of side footings as opposed
to5~ of the cost of front footage (City pays the other 50%), is
that while the property does not receive the full benefit of the

lighting, there is substantial benefit to the property owner from
the lighting of the side yard property. It was felt the property
owners should share in the cost of the improvement to some degr22
and that 20% of one-half of the cost would not be burdensome.
In the instance where the corner properties face the cross
street, as follows,

the Z-pattern would not be used to light the street. Lots 1, 2,
3, and 4 would be assessed 20% x side footage x 1/2 cost/foot as
they receive partial benefit from the lights. Lots 5, 6, 7, 8,
9, 10, 11, and 12 would be assessed 50% of the cost at the time
their block was lighted. Lots 1, 2, 3, and 4 would also have to
pay the appropriate front foot cost if lighting is placed on the
street facing their home.
The City of Los Angeles has an even stricter assessment policy
than does the City of Santa Monica. The residential property
owner is assessed 50% of the side yard footage for a 60 foot
front yard. For each front yard which is + 60-foot, the property
owner is charged + 1/2% per foot of variance. In addition, the
property owner pays 100% of the cost for the front footage.

The present street lighting district does not make use of the
Z-pattern of lighting. Two properties front onto Seventeenth
Street. In this district, a street light is located at the
property line of one of these properties. This light illuminates
not only the driveways of both the properties, but also their
front doors which face onto Sunset Avenue. These properties will
be assessed as follows:
20% x 105 side feet x $6.9025/foot $144.45
(1/2 of cost)
The average assessment for this district is $345.13.
In addition to avoid the confusion of the previous district
regarding involuntary liens, staff will not record the Notice of
Assessment with the County recorder until all cash payments have
been received by the contractor.
Recommendation
It is recommended the City Council:
1) Open the public hearing.
2) Close the public hearing and overrule any
protests; and
3) Adopt the resolution approving the assessment
diagram and confirming the assessments.

for in Resolution of Intention No. 6099 (C.C.S.), passed
by the City Council of said City on October 14, 1980:
Fursuaht to and in accordance with the statute, "Improve-
ment Act of 1911", being Division 7 of the Streets and
.Highways Code of the State of California:
I, Stanley E. Scholl, as Street Superintendent of said City, do
hereby certify that that certain contract, entered into by and
between Pete's Electric as contractor and Stanely E. Scholl as
Street Superintendent, and Charles Kent McClain as City ?".anager,
of said City, on the 25th day of June, 1981, for construction-
. of street lighting and appurtenant work on Sunset Avenue between
Seventeenth Street and Dewey Street, all within the City, has
been fulfilled and performed to my satisfaction., that I have
accepted the work contracted for, and that I have estimated upon
all lots, portions of lots and parcels of land within the assess-
ment district described in said Resolution of Intention and shown
upon the diagram hereto attached, prepared by the City Engineer,
the benefits arising from the work performed under said contract
and to be received by each of said lots; portions of lots and
parcels of land within the said assessment district, and as such
Street Superintendent, I do now hereby assess upon the lands in
said assessment district the sum of
$12,248.96
the said sum being the total assessable amount due for the work
performed and specified in said contract, together with incidental
expenses as follows:

THE CITY OF SANTA MONICA APPROVING
ASSESSMENT DIAGRAM AND CONFIRMING
ASSESSMENT FOR SUNSET AVENUE
BETWEEN SEVENTEENTH STREET AND
DEWfY STREET..
~dHEREAS, the City of Santa Monica, pursuant to
Section 5100 et seq. of the Streets and Highways Code, commenced
proceedings to construct street lighting and appurtenant work on
Sunset Avenue between Seventeenth Street and Dewey Street; and
WHEREAS, the proceeding: is more-fully described in
the Resolution of lntention adopted by the City Council an
October 14, 1980, being Resolution No. 6099 (CCS); and
WHEREAS, the contract for the above-described work
has been fulfilled to the satisfaction of the Superintendent of
Streets;: and
WHEREAS, the Superintendent of Streets has made an
assessment to cower the sum due for the work performed. and
specified in the contract; and.
WHEREAS., the assessment has been filed with the
City Clerk; and

WHEREAS, the City Clerk gave the notice required
by Section 5362 of the Streets and Highways Cade; and
WHEREAS, upon the day and hour fixed for hearing
by the City Clerk, the City Council of the City of Santa Monica
heard and passed upon any an all objections, appeals, and
protests,.
NOW THEREFORE, THE CLTY COUNCIL OF THE CITY OF
SANTA MONLCA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION- 1. That. all objections, appeals, and.
protests of every kind and nature be and the same are hereby
overruled. and denied.
SECTLON 2. That the diagram of property affected
artd benefited by the construction of a high-press-ure sodium
street lighting system and appurtenant work on Sunset Avenue
between Seventeenth Street and Dewey Street, all in the City of
Santa Monica, as more: fully described in Resolution No. 6099
(CCS) and therein declared to be the property to be assessed to
pay the expense of the improvement, is: approved and the City
Clerk is directed to execute the certificate om the diagram
certifying such approval and to deliver the diagram to the
Superintendent of Streets.
