SUBJECT: Public Hearing on the Street Lighting District Composed of:
Oak Street between 23rd and 25th Streets, Ocean Park Boulevard
between Euclid and 14th Street
Introduction
This report requests the City Council hold public hearings for street lighting
on Oak Street between 23rd and 25th Streets and on Ocean Park Boulevard
between Euclid and 14th Street. and to adopt the attached resolutions under
the Improvement Act of 1911.
Background
Citizens in the area of Oak Street between 23rd and 25th Streets and Ocean
Park Boulevard between Euclid and 14th Street have requested the City Council
form a street lighting district.
In accord with Council policy, the City pays half the cost of the project
installation. The estimated cost to the City is $37,750 to be appropriated
prior to award of contract. The property owners will be assesed for the
remainder. Payment may be in cash or by yearly installments on a 10-year
bond at 7% interest.
On January 27, 1981, the Council accepted a petition and initiated this
project by adoption of Resolution No. 6182 and a Resolution of Intention
No. 6183 setting public hearings for February 24,. 1981. One hearing is on
public convenience and necessity and the other on the Resolution of Intention,
all in accordance with the 1911 Act proceedings of the Streets and Highways
Code.

Recommendation
It is recommended the City Council:
I. Open the public hearing on the convenience and necessity;
2. Close the hearing;
3. Appropriate $37,750 from General Fund Reserves for the City's
one half of the construction cost;
4. Adopt the attached resolution finding the public convenience
and necessity require the construction;
5. Open the public hearing on the Resolution of Intention;
6. Close the hearing; and
7. Overrule any and all objections and adopt the attached resolution
ordering the work.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA FINDING THE PUBLIC CONVENIENCE AND
NECESSITY REQUIRE THE CONSTRUCTION OF STREET
LIGHTING ON OAK STREET BETWEEN 23RD AND 25TH.
STREETS AND ON OCEAN PARK BOULEVARD BETWEEN
EUCLID AND 14TH STREETS.
WHEREAS, a public hearing has been held duly and regularly
pursuant to Resolution No. 6182 (CCS), and the laws and Constitution of the
State of California on the proposed improvement on Oak Street between 23rd
and 25th Streets and on Ocean Park Boulevard between Euclid and 14th Streets
by the construction of street lighting and appurtenant work thereto, as
described in the Resolution of Intention No. 6183 (CCS), for said work, all
within the City of Santa Monica; and
WHEREAS, said improvement has been considered fully;
NOW., THEREFORE, THE. CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1: That the said City Council hereby finds and deter-
mines that the public convenience and necessity require the improvement on
Oak Street between 23rd and 25th Streets and on Ocean Park Boulevard between
Euclid and 14th Streets by the construction of street lighting and appur-
tenant work thereto, as described in the Resolution of Intention No. 6183 (CCS).
SECTION 2: That the said City Council hereby finds and
determines further that the "Special Assessment Investigation, Limitation
and Majority Protest Act of 1931" shall not apply to the making of said
improvement.
SECTION 3: That the said improvement shall be conducted
under the Improvement Act of 1911, which is Division 7 of the Streets and
Highways Code of the State of California, and the Street Superintendent
and the City Attorney presented to the said City Council the Resolution of
Intention required by said Improvement Act to initiate the proceedings for
said improvement.
SECTION 4: The City Clerk shall certify to the adoption of
this resolution and thenceforth and thereafter the same shall be in full
force and effect.
