AN ORDINANCE OF THE CITY COUNCJL OF THE CITY OF SANTA MONICA
AMENDING VARIOUS SECTIONS OF CHAPTER 3.16 OF THE SANTA
MONICA MUNICIPAL CODE RELATING TO PARKING METERS
WHEREAS, the City of Santa Monica currently recognizes Lincoln's
Birthday, February 12, as a holiday, and does not require payment at on-street
parking meters on that day; and
WHEREAS, the City of Santa Monica currently does not recognize Martin
Luther King Jr. Day, the third Monday in January, as a holiday, and does require
payment at on-street parking meters on that day; and
WHEREAS, neighboring cities recognize Martin Luther King Jr. Day but do
not recognize Lincoln's Birthday for on-street parking meter purposes; and
WHEREAS, in order to ease confusion of drivers traveling between Santa
Monica and neighboring cities, the City of Santa Monica desires to recognize
Martin Luther King. Jr. Day as a holiday and. to cease recognizing Lincoln"s
Birthday for on-street parking meter purposes; and
WHEREAS, a past Municipal Code amendment erroneously granted
parking meter fee exemptions on weekdays before or after certain weekend
holidays, and that error should be corrected to protect City revenues.
NOW, THEREFORE; THE CITY COUNCIL OF THE CITY OF SANTA I1111ONICA
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION i, Section 3.16.fl4fl ofi Chapter 3.16 of the Santa Monica Municipal
Code is amended to read as follows:

and any other day designated by the City Cauncii of the City
of Santa Konica as a day for publio feast, thanksgiving or
holiday.
SECTION 2. Section 3.16.124 of Chapter 3.16 of the Santa Monica iVlunicipal
Code is arr~eraded to read as follows:

{a) Unless exempt pursuant to subdivisian (b) or {c} of this
section, when any vehicle shall be parked in any metered
parking space, the operator immediately shall deposit

payment in the manner prescribed on the parking meter or at
the parking space. Unless otherwise permitted by iaw, no
person shall park a vehicle in a designated metered parking
space in excess of the maximum parking time limit set by the
Director of Planning and Community Development, ar his or
her designee.
{b} Subdivisian {a} of this section sha(I nat require an
operatar of a vehicle to deposit payment in a parking meter
when:
{1) the parking meter indicates an unexpired portion
remains of the period for which payment had been
previously made; or
{2) an officer of the Fire or Police Department has
determined a period of emergency exists: or
{3} in oampliance with the directions of a pofioe officer
or traffic control sign or signal; or

{o) Subdivision {a) of this section shall not require an
operator of a vehicle to deposit payment in a parking meter if
the vehiole is lawfully displaying one of the following valid
and current decals, placards or plates issued by the
California Department of Motor Vehioles:
(1) Clean Air orZero-Emissions Vehiole Decal; or
{2} any Special I~eoognition Plate.
SECTIOi~I 3. Any provision of the Santa Manioa Municipal Code or appendices
thereto inconsistent with the provisions of this Ordinance, to the extent of such
inconsistencies and no further; is hereby repealed or modified to that extent necessary
to effec# the provisions of this Ordinanoe.
SECTIOhI 4. If any section, subsection; sentence, olause, or phrase of this
Ordinanoe is for any reason held to be invalid or unconstitutional by a decision of any
court of competent jurisdic#ion, such decision shall not affect the validity of the
remaining partions o€ this Ordinanoe. The City Counoil hereby declares that it would
have passed this Ordinance and each and every section, subsection, sentence, cause,
or phrase not declared invalid or unconstitutional without regard to whether any portion
of this Ordinance would be subsequently declared invalid or unconstitutional.
SECTIOP~ 5. The Mayor shall sign and the City Clerk shall attest to the passage
of this Ordinance. The City Clerk shall cause the same to be published once in the

official newspaper within 15 days a#ter its adoption. This Ordinance shall become
effective 30 days #rom its adoption.
