A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONIGA
AUTHORIZING THE CITY MANAGER TO SUBMIT AND EXECUTE USED OIL
PAYMENT PROGRAM APPLICATIONS TO THE DEPARTMENT OF
RESOURCES RECYCLING AND RECOVERY (CalRecycle)
WHEREAS, pursuant to Public Resources Code § 48690 the Department
of Resources Recycling and Recovery (CalRecycle), formerly known as the
California Integrated Waste Management Board {CIWMB), has established the
Used Oil Payment Program {OPP) to make payments to qualifying jurisdictions
for implementation of their used oil programs; and
WHEREAS, pursuant to Public Resources Code § 48690 the Department
of Resources Recycling and Recovery {CalRecycle), formerly known as the
California Integrated Waste Management Board (CIWMB), has established the
Used Oil Payment Program (OPP) to make payments to qualifying jurisdictions
for implementation of their used oil programs; and
WHEREAS, in furtherance of this authority CalRecycle is required to
establish procedures governing the administration of the Used Oil Payment
Program; and
WHEREAS, the Used Oil Payment Program allows regional participation;
and
WHEREAS, CalRecycle's procedures for administering the Used Oil Payment
Program requires, among ether things, a regional applicant's governing bady to declare
by resolution certain authorizations related to the administration of CaiReaycie's Used
Oil Payment Program.
NOW, THEREFORE; THE CITY COUNCIL OF THE CITY OF SANTA MONICA
C7OES RESOLVE AS FOLLOWS:
SECTION 1. The submittal of regional applications to the 17epartment of
Resources Recovery and Recycling for the Used Oil Payment Program on behalf of
itself as Lead Agency and the County of Los Angeles as participating agency for a
period of five years from Juiy 28, 2010 through July 2~, 2014 is hereby authorized.
SECTION 2. The City Manager, or designee is hereby authorized to execute in
the name of the City of Sanfia Monica all necessary applications, agreements, contracts,
annual reports, expenditure reports, and amendments, thereto far the purposes of
securing payments and to implement and carry out the purposes of the Used Oi!
Collection Program.
SECTION 3. The City Clerk steal! certify to the adaption of this Resolution, and
thenoeforth and thereafter the same shall be in full farce and effect.
