California 90407-220C Mayor and Councilmembers City of Santa Monica 1685 Main Street Santa Monica, CA 90401 Dear Mayor Shriver and City Councilmembers: ~o-~ JUL 13 2010 At its June 17, 2010 Commission meeting, the Santa Monica Recreation and Parks Commission voted unanimously to recommend to the City Council that Section 2.12.155 of the City Code be changed to allow for two Commissioner Emeritus positions who may service on the Recreation and Parks Commission. The current Code Section allows for City Council appointment up to one Commissioner Emeritus based upon the recommendations of the Commission. To be eligible for appointment, a person must have served two full terms as a Commissioner and must be a resident within the City. The Commissioner is a nonvoting member, may represent the Commission at community and other functions as directed by the Commission, may serve on Commission committees and shall abide by the bylaws of the Commission. The term for the Commissioner Emeritus is two years, and the Commissioner Emeritus may serve a maximum of two consecutive terms. The Commissioner Emeritus is not eligible to serve simultaneously as a voting member on another City Commission. This charter section was codified pursuant to City Council approval of Ordinance Number 2272CCS & 1, adopted on October 14, 2008. Currently, the existing Commissioner Emeritus, frank Schwengel, has reapplied for his second term. At its June meeting, the Commission reaffirmed its support for this appointment and took the action above in order to allow for a second emeritus position. This motion also included a recommendation to Council to subsequently appoint current Chair, Susan Cloke, to fill that position for atwo-year term effective as soon. as all the ordinance changes are in place. The Commission believes that both Frank and Susan have unique and important roles to fill and that the City and the Commission would be well served if they both could fill emeritus positions. Santa Monica Municipal Code Section 2.12.155 is hereby added fo the Santa Monica Municipal Code to read as follows: 2.12.155 Commissioner(s) Emerifus. Any provision of the Santa Monica Municipal Code or appendices thereto inconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, is hereby repealed or modified to that extent necessary to effect the. provisions of this Ordinance. SECTION 3. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent. jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would. 2 have passed this Ordinance and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstifutiona! without regard #o whether any portion of the ordinance would be subsequently declared invalid or uncons#itutional. SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. The City- Cferk shalt cause the same to be published once in the official newspaper within 15 days after its adoption. This .Ordinance shall become effective 30 days from its adoption.
