R-10488ATTACHMENT D2 City Council Meeting 6-15-2010 Santa Monica, California RESOLUTION NO. ~oass (CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ESTABLISHING FEES FOR FIRE DEPARTMENT RESPONSE TO AND HAZARDOUS MATERIAL FROM TRAFFIC ACCIDENTS AND FOR ADVANCED LIFE SUPPORT (ALS) RESPONSE TO NON-ALS PATIENT INCIDENTS AT SKILLED NURSING FACILITIES WHEREAS, it is the policy of the City of Santa Monica to charge for the full costs of services provided by City Staff when such services benefit individual users rather than members of the community as a whole; and WHEREAS, the City desires to establish a fee to recover Fire Department costs of responding to ahd clean-up and removal of hazardous waste discharges resulting from vehicular accidents; and WHEREAS, the Fire Department is asked by skilled nursing facilities to respond to non life threatening incidents; and WHEREAS; these responses result in emergency response personnel not being available for other calls that may be more critical in nature; and ATTACHMENT D2 WHEREAS, the City desires to establish a fee to recover its costs for advance life support (ALS) responses to incidents at skilled nursing facilities for non life threatening incidents; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. A fee of $490.00 per hour with a one hour minimum charge is hereby established for Fire Department response to and clean-up of hazardous materials discharge resulting from a vehicular accident. SECTION 2. A fee of $490.00 per hour with a one hour minimum charge is hereby established and assessed to skilled nursing facilities for patient assessment and care provided to patients not requiring ALS care and/or ambulance transport to a hospital. SECTION 3. The fee established per Section 2 of this resolution will not be assessed if it is determined that the patient requires ALS care and transport to a hospital. SECTION 4. Commencing on July 1, 2011 and on July 1 of each fiscal year thereafter all fees established by this resolution, unless noted otherwise, shall be administratively revised and increased annually by a factor equal to the difference in the Los Angeles-Anaheim-Riverside Consumer Price Index for Wage Earners and Clerical Workers for the twelve (12) month period February through February of the prior fiscal 2 year, except that any such administrative revision shall not be less than any annual cost of living adjustment provided to the employees of the City of Santa Monica through Memorandums of Understanding entered into between. the City and the employees' bargaining representatives for the comparable fiscal year, and in no event shall the annual administrative revision be less than zero percent (0%). SECTION 5. The fees established by this resolution will take effect July 1, 2010. SECTION 6. The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect.
