April 27, 2010 13-C: Request of Councilmember McKeown that the Council authorize City of Santa Monica support for two housing-related bills in the state legislature: AB2337 (Ammiano), prohibiting Ca1PERS/CaISTRS investments in companies that operate "predatory equity schemes'° designed to profit from practices that displace tenants from rent-controlled housing; and AB2743 (Nava), prohibiting landlords from establishing rental policies that require tenants or potential tenants to have pet animals devocalized or declawed. Attached: Related Legislative Digests. 1 April 27, 2010 0 April 27, 2010 AB 2337 (Ammiano) -- prohibiting CaIPERS /CaISTRS investments in companies that operate "predatory equity schemes" designed to profit from practices that displace tenants from rent-controlled housing units -- passed today out of the Assembly Committee on Public Employment, Retirement and Social Security (on a straight party- line vote). This bill appears to be entirely consistent with existing City policy, including these elements of the City's "Legislative Policies" document: The City supports efforts to provide greater protection of displaced tenants, such as ensuring the continued enforcement of rent control, when mobile home parks are converted into condominiums (2007). * The City supports efforts to provide vulnerable tenants with additional rights and protections from landlord abuses. (and) AB 2743 (Nava) -- prohibiting a landlord, that allows a tenant to have an animal on the premises, from advertising or establishing rental policies in a manner that requires a tenant or a potential tenant with an animal to have that animal debarked or declawed, for other than therapeutic purposes, as a condition of occupancy -- is going to be heard the first-time in the Assembly Committee on Judiciary on April 27. I called the California Apartment Association about their position. They say they ARE, in fact, in SUPPORT of the bill This bill appears to be entirely consistent with existing City policy, including these elements of the City's. Section 7513.75 to the Government Code, relating to investments. LEGISLATIVE COUNSEL'S DIGEST AB 2337, as introduced, Ammiano. Public retirement system: investments: predatory investment practices. The California Constitution provides that the Legislature may by statute prohibit retirement board investments if it is in the public interest to do so, and providing that the prohibition satisfies specified fiduciary standards. Existing law prohibits the Public Employees' Retirement System and the State Teachers' Retirement System from investing public employee retirement funds in a company with active business operations in Sudan and Iran, as specified. Existing law also requires these retirement systems to sell or transfer any investments in a company with business operations in Sudan. Existing law requires these retirement systems to submit an annual report to the Legislature regarding any investments in a company with business operations in Sudan and the sale or transfer of those investments. Existing law requires the state to indemnify, from the General Fund, and hold harmless the present, former, and future board members, officers, and employees of, and investment managers under contract with, these retirement systems by reason of any decision to restrict, reduce, or eliminate investments in Sudan, as specified. This bill would additionally prohibit the Public Employees' Retirement System and the State Teachers' Retirement System from investing public employee retirement funds in a company. with business operations engaged in predatory investment practices that rely on, or result in, the displacement of persons residing in rent-regulated housing in order to generate profits to investors. The bill would require the Board of Administration of the Public Employees' Retirement System and the Teachers' Retirement" Board of the State Teachers' Retirement System to sell or transfer any investments in a company with business operations engaged in predatory investment practices, as specified. This bill would make related legislative findings and declarations. This bill would. require these boards to report to the Legislature any investments in a company with specified business operations engaged in predatory investment practices and the sale or transfer of those investments, subject to the fiduciary duty of these boards, by January 1, 2012, and every year thereafter. BILL NUMBER: AB 2743 AMENDED BILL TEXT AMENDED IN ASSEMBLY APRIL 8, 2010 INTRODUCED BY Assembly Member Nava FEBRUARY 19, 2010 An act to add Section 1942.7 to the Civil Code, relating to rental property. LEGISLATIVE COUNSEL'S DIGEST AB 2743, as amended, Nava. Real property: rentals: animals. Existing law regulates the terms and conditions of residential tenancies and governs the obligations of tenants and landlords under a lease or tenancy. This bill would prohibit a landlord, that allows a tenant to have an animal on the premises, from advertising or establishing rental policies in a manner that requires a tenant or a potential tenant with an animal to have that animal debarked or declawed, for other than therapeutic purposes, as a condition of occupancy. This bill would impose a civil penalty of not more than $2,500, to be paid to any individual harmed by a violation of these prohibitions. Vote: majority. Appropriation: no. Fiscal committee: no.
