SUBJECT: Accept Petition and Set Public Hearing for June 22, 1982,
on the Street Lighting Petition for 500 Block of Twelfth
Street and Berkeley between Montana and Wilshire
Introduction

City stafF has received two petitions for the installation of street
lighting on the following streets: 500 Block of Twelfth Street and
Berkeley between Montana and Wilshire. The petition for the 500 Block
of Twelfth Street is signed by 61% of the property owners and the
petition for Berkeley between P.lontana and Wilshire is signed by 75%
of the property owners. Both petitions meet the requirements of
Chapter 27 of the Improvement Act of 1911.
Background
The City Engineer's estimate for the total cost of the installation of
street lights on the 500 Block of Twelfth and Berkeley between Montana
and Wilshire is $116,736. The City's portion of funds for these projects
is estimated at $58,368, as it has been City policy to pay for one-half
the cost of installation of street lights in residential areas. The
City's share of the cost must be appropriated at the time the contract
is awarded to ensure funds will be available for construction. The
attached Resolution setting a public hearing allows bonds to be issued
at 7% interest for any property owner's unpaid assessments over $150.00.

The 1981/82 budget includes $657,500 for street light maintenance
(including energy and conversions of existing lighting). Projected
expenditures will use all of these funds seven if no new street .lights
are approved. To date, no funds have been appropriated for any new
street lighting projects.
However, two street lighting districts, the 200 Block of Euclid and 25th
Street between Pearl and Ocean Park, have been approved previously by
Counci'1 and have been incorporated into one project. The City's portion
of funds for this project is estimated at $35,875. An appropriation will
be required on this project when the contract is awarded for this work.
Zn January 1982, Council imposed a freeze on street lighting petitions
until staff could return with a report proposing an equitable distribution
method for installing street lights in single-family and multi-family
areas. This report cannot be completed until the Rent Control Board
adopts a pass-through formula. for tenants or until the Council makes
a decision on another method of financing the lighting in multi-family
areas.. Prior to this, on June 23, 1981, City Council directed the. City
Attorney to draft an ordinance which would enable tenants to inititate
street light petitions. On July 28, 1982, the ordinance was introduced.
Council directed that the ordinance not be returned for second reading
until the Rent Control Board had acted on the matter.. At this point,
staff is still awaiting adoption of a formula by the Rent Control Board.
Staff is requesting Council to lift the freeze on the Berkeley and Twelfth
Street petitions for the following reasons:

1. The Berkeley petition had been received by staff prior
to the freeze. Due to time limitations, it had not yet
been presented to Council.
2. The petitioners for Twelfth Street requested the petition
prior to the freeze and worked diligently to complete
the petition not knowing about the freeze.
3. The residents of both streets are requesting action on
their petitions.
The City's total cost for all four petitions, Euclid, 25th Street, Twelfth
Street and Berkeley is $94,241. Considerable funds can be saved for both
the City and the property owners. if these projects are combined so that
there will be only one contract.

Recommendations
It is recommended City Council accept the attached petition and approve
the attached Resolution, establishing the proposed district for the 500
Block of Twelfth Street and Berkeley between Montana and Wilshire under
Chapter 27 of the Improvement Act of 1911 and setting a public hearing
for June 22, 1982.
