Introduction
This report transmits an appeal from the Planning Commission's
determination to extend a Tentative Tract Map for a condominium
conversion. The appeal is by Council Member William Jennings.
Background
Under the State Map Act a Tentative Tract Map will expire after
one year unless a Final Map is approved within that time. The
Map Act also provides that the Planning Commission may extend
a Tentative Tract Map for a period of up to two additional years
to allow completion of the processing. The Map Act does not reg-
ulate the oirciimstai~ces under which a map should or should not
be extended leaving the discretion to the local agency. Due to the
heavy volume of tract maps being proposed in Los Angeles County
as well as changing requirements in regard to condominium con-
versions, developers have not been able to complete all require-
ments within the one year period, particularly processing appli-
cations for vested rights or removal permits through the Santa
Monica Rent Control Board. Many appear to .have delayed making
such applications for fear of denial. In November, the City

Council established the policy that no Final Tract Map should
be considered until rent control approval had been obtained.
On February 4th the Planning Commission granted a six month
extension on condition that an application for a vested right,
removal permit or exemption be sought from the Rent Control
Board and that such approval be obtained before the Final Map
is approved.
This determination was appealed by Council Member Jennings.
Alternatives
Under the City Subdivision procedures the City Council may af-
firm, reverse or modify any determination of the Planning Com-
mission in regard to any subdivision including extension of a
Tentative Tract Map.
While the Map Act is silent as to the qualifications for an
extension,-the obvious intent is to allow the local agency to
grant additional time where circumstances have precluded reason-
able completion of all requirements and allow the imposition of
any new conditions that may be warranted by changing circumstances.
Approval by the Rent Control Board has been required since Novem-
ber and sufficient time for the applicant to seek that approval
should be allowed. The Planning Commission determined that six
months was an adequate period and therefore extended the Map 'this
amount.

action be affirmed.
