Introduction This report transmits a Final Map for City Council approval of the following condominium project which received Tentative Approval December 3, 1979: TRACT ADDRESS DEVELOPER UNITS 37947 823-827 Seventeenth Street Jack Kavanaugh & 11 (new) Mead L Greenberg Background After public hearing and careful` review of the record and staff recommendations, the City Planning Commission approved the Tentative Map for the above project. The action of the. Planning Commission was based on their finding that the pro- posed subdivision should cause ho substantial environmental damage and is in conformance with all state and local taws and regulations and applicable General Plan Elements. The Final P4ap conforms to the Tentative Map. The License Division reports that the developer has either paid or agreed to pay the condominium tax. The Building and Safety and Fire Departments indicate that the project meets present fire safety requirements.. Approval by the County Engineer's office has been received for the project. A house and two units were removed by April 4, 1979. The properties. were purchased October 30, 1979 with a house up on blocks on 827 Seventeenth Street (note attached exemption letter):. A building permit was issued January 18 but construction has not been started. Alternatives State and City ordinances require approval of .final subdivision maps which comply with approved Tentative Maps. Approval of the Final Subdivision Map does nct ~o ,,, j<< tAAR 2 51980 Mayor and City Council Page 2 release the subdivider from compliance with. any applicable requirements of the Rent Control Ordinance. Recommendation Inasmuch as the Final Map conforms to the approved Tentative Map, the buildings meet required safety standards and the tax has been paid or an agreement to pay executed, it is respectfully recommended that the City Council affirm the find- ings of the Planning Corr¢nission and approve said Map with the advisement that approval of the Final Subdivision Map does not release the subdivider from compliance with the Rent Control Ordinance requirement for an exemption or removal permit.
